Application for an Amendment to the Conditions of Exemption Authority

Exhibit A

Requests an amendment to its Exemption Authority granted on May 15, 1995 under Docket Number 50296 and extended on June 5, 1996 under Docket OST 96-1372 to delete the Special Condition limiting the operations of ABSA to wet lease operations, prohibiting ABSA from conducting operations with its own crew and aircraft and requiring ABSA to obtain a statement of authorization from the Department of Transportation prior to conducting any charters to/from the United States. ABSA is requesting the removal of these Special Condition because ABSA has been issued operating authority under Section 402 and/or 416(b) of the Federal Aviation Act, as amended, in accordance with the Memorandum attached as Exhibit "A." ABSA further requests that this Application be processed on an expedited basis.

Notice of Action

We approved that part of ABSA’s request to delete the requirement that its operations be conducted under wet lease from a duly authorized and properly supervised US or foreign carrier and, thereby, authorized the carrier to conduct operations with its own aircraft and crew. Dismissed ABSA’s request to the extent that it requested that the prior approval conditions of its authority be deleted. Further, ABSA’s Department authority is subject to the terms, limitations and conditions of the 1995 US-Brazil Air Transport Agreement and the attached standard exemption conditions.
