Air Atlantic respectfully requests the Department to defer the issuance of any authority to Air Atlantic Dominicana which could be deemed to authorize it to hold out and provide foreign air transportation under the trade name "Air Atlantic" pending notification that Air Atlantic Dominicana and Air Atlantic have resolved the trade name issues described in this Answer.

As for IMP's purported "extensive" Canada-U.S. operations, according to the OAG IMP's sole operations to the U.S. appear to be to Boston, MA from Halifax, Nova Scotia and St. John, New Brunswick using small British Aerospace J-41 turboprop commuter aircraft (approximately 28 seats).

Surreply of IMP Group c.o.b.a Air Atlantic and Motion for Leave to File

Air Atlantic has provided irrefutable evidence of a "significant potential for . . . public confusion" arising from the fact that Air Atlantic's trade name, and the trade name proposed to be used by Dominicana, are identical. Air Atlantic does not request the Department to resolve any dispute over its legal right to use the name "Air Atlantic" in the United States -- if necessary, a U.S. court will resolve that issue if Dominicana persists in attempting to usurp that name.

Surreply of Air Atlantic Dominicana to Surreply of IMP Group Limited and Motion for Leave to File

Regarding IMP's various charges against Air Atlantic and its November 5, 1996 Answer, Air Atlantic respectfully submits that it was certainly never its intention to be in any way snide, denigrating or inappropriate toward IMP or its operations and that Air Atlantic, in fact, was not. Similarly, Air Atlantic has been neither factually careless nor engaged in any sort of attack on IMP as charged. Indeed, until IMP's October 30, 1996, Answer and Motion to file late, Air Atlantic was not even aware of IMP's existence. Air Atlantic's lack of knowledge as to IMP merely reflects the fact that IMP operates to the U.S. under the banner of Canadian Airlines International (a fact IMP has not contested) and that it does not serve the Dominican Republic, nor does it serve Miami, FL, New York, NY or San Juan, PR, the only markets Air Atlantic is authorized to serve and the only U.S.-D.R. markets which actually exist
