- Application for Amendment of an Exemption
American International Airways, Inc. ("AIA") applies for amendment of an exemption from 49 U.S.C. §41101 (a) to add Guam as a coterminal point on the carrier's Honolulu - Melbourne - Jakarta all-cargo service. AIA plans to begin this service no later than June 29, and requests that the authority be awarded expeditiously to facilitate planning and marketing of this service. AIA further requests that the amendment become effective immediately and remain in effect for a two-year period or until the Department grants AlA's application for certificate authority (to be filed shortly), whichever occurs first.

By Order 96012 the Department issued American International Airways (AIA) a certificate of public convenience and necessity to provide scheduled all-cargo services between the United States and Brazil (Route 695). By its terms the certificate would expire August 4, 1996, unless AIA commences service by that date. AIA sought exemption from its startup condition to the extent necessary to extend its proposed startup date to September 18, 1996. AIA stated that it has not yet received the necessary license from the Brazilian Government but expected that appropriate Brazilian authority for its scheduled operations will be secured by or before September 18, 1996

Application of American International for an Exemption to Delay Start of
Service
As was the case in July, AIA is commercially and operationally prepared to begin its Brazil service. The carrier has been operating a heavy schedule of charter flights pursuant to monthly allocations of 20 charter flights from the DAC. AIA has been working closely, through local counsel, with the DAC, and has submitted extensive documentation. AIA is confident that all relevant materials are now under review by the DAC, and officials of the DAC have advised undersigned counsel that provisional authority should be issued shortly. Out of an abundance of caution, however, AIA has requested a 45-day exemption period to avoid another extension request should additional unforeseen administrative delays take place.
Requests expedited treatment, answers are due by September 16, 1996, so the DOT may act by September 17, 1996
