In a nutshell, under the carriers, agreement, Continental and Air France will code-share on each other's transatlantic flights between Paris and Newark and Paris and Houston. In addition, Continental will code-share on Air France's Miami-Paris flights and initially on Air France flights between Paris and thirteen (13) domestic French points, and beyond Paris to points in Germany, Belgium, Denmark, Sweden, Norway, Switzerland, Austria and Finland. (These are European countries that have entered into Open Skies Agreements with the United States.)

Air France in turn will code-share on Continental domestic flights between Newark and Houston and various U.S. cities, including Cleveland, Dallas/Fort Worth, Detroit, Syracuse and Pittsburgh

Answer of The City of Houston and The Greater Houston Partnership

Continental plans to use the authority sought. in conjunction with its reciprocal codeshare agreement with Air France, 2 to funnel significant passenger and cargo traffic between the U.S. and France through Houston. More specifically, the two carriers intend to codeshare between Paris and other points in France. as well as points in Austria, Belgium, Denmark, Finland, Germany, Norway, Sweden, and Switzerland (pending all requisite government approvals), and between Houston and the following U.S. cities: Dallas/Fort Worth, Austin, and San Antonio, Texas; Philadelphia and Pittsburgh. Pennsylvania; Cleveland, Ohio; Albuquerque, New Mexico; Buffalo, Syracuse, and Rochester. New York; Norfolk/Virginia Beach, Virginia; and Metro Wayne County, Michigan. Houston, with its thriving local economy, the nation's fourth largest airport system, and one of the fastest growing airline hubs in the U.S., is working with Continental to maximize the benefits of this enhanced network.

Houston enjoys close economic and cultural ties to France. France is Houston's third largest air cargo trade partner. accounting for over 7.2 million kilograms in 1997. Seabome trade with France, meanwhile, was valued at nearly $1.9 billion in 1996. Close to 170 Houston companies trade with France. Nearly 50 Houston companies have subsidiaries in France. 48 French companies, meanwhile, have offices in Houston, including six of the largest French banks. France has a Consulate General. a trade commission, and an "Invest in France" agency in Houston. Over 93,000 persons of French ancestry live in the Houston metropolitan area. Clearly, therefore. Houston is well positioned to become a major gateway in the U.S.-France air transport market.

On April 22, 1998, United filed a consolidated answer to the Joint Applicants' docketed exemption applications (Dockets OST-98-3739/3740/3744) seeking underlying authority for the proposed code-share operations, which answer United incorporates herein. In summary, United has no objection to expeditious action on the code sharing authorizations of the Joint Applicants so long as the new Departmental authority requested by United to support its code share service to France (Docket OST-98-3732) is approved no later than that of the Joint Applicants.

Re: Joint Application for Statements of Authorization for Blanket Codeshare Authority - Answer of United Air Lines, Inc.

United urges the Department to consider this matter carefully. The grant of a blanket statement of authorization to Continental and Air France would require the grant of similar authority to code-share partnerships involving foreign carriers from virtually every country with which the U.S. has an agreement allowing code sharing, no matter how restrictive. There would be little to distinguish foreign carriers from countries with relatively restrictive bilateral code-share agreements once Air France was granted such blanket authority.

Re: Joint Application for Statements of Authorization - Joint Reply of Continental Airlines and Air France

Continental and Air France hereby reply to United's answer in this proceeding and urge the Department to approve their application for blanket code-share authority immediately so the Joint Applicants can begin marketing the code-share services proposed during the 1998 peak summer travel season. The Department should not allow United to delay implementation of the code-sharing proposed by Continental and Air France. United does not dispute that the proposed code-share services are expressly authorized by the U.S.-France Agreement, object to code-sharing involving the countries on the Joint Applicants' list of initial code-share points or object at all to this application. Instead, United urges the Department "to reflect carefully" on alleged policy implications of the Continental/Air France request for blanket code-share authority. Doing so would be contrary to the U.S.-France bilateral agreement, which authorizes the blanket authority sought by the Joint Applicants. Indeed, the Department has already issued blanket statements of authorization covering U.S.-France and other thirdcountry code-sharing services of Continental and Air France.

Awarding limited U.S.-Romania code-share authority available April 1, 1999, to the airlines offering the maximum number of U.S. gateways, as proposed in this proceeding, would perpetuate the dominance of the largest airlines and the largest alliances and inhibit the immediate entry of a new competitor between the U.S. and Eastern Europe. Since U.S.-Romania code-sharing is new, the Department has an extraordinary opportunity to authorize Continental and Air France to start service at the same time as other, larger alliances which have already blanketed Eastern Europe with code-share service. Thus, Continentals objects to the Department's tentative decision awarding Delta, Northwest and United the three U.S. carrier designations now available April 1, 1999. Continental urges the Department to reverse its tentative decision and award Continental U.S.-Romania code-share authority effective April 1, 1999, for the reasons set forth in its application, consolidated answer and consolidated reply.

Notice of Termination of Codeshare Services

Pursuant to the conditions in Statements of Authorization 98-303 and 98-330 (August 9, 1998), Continental, Continental Express and Air France notify the Department that they will terminate all codesharing by Continental beyond Paris on Air France flights on March 25,2001, and all codesharing by Air France beyond New York/Newark and Houston on Continental and Continental Express flights on April 1, 2001. Codesharing between U.S. and French gateways will continue except for codesharing on Air France’s Miami-Paris flights, which will terminate on March 25, 2001.
