As to each market, Aerolitoral either is serving the market with nonstop flights or wishes to maintain authority so that it can resume nonstop service should conditions warrant.

Joint Application for Exemptions and a Statement of Authorization

Aerovias de Mexico, S.A. de C.V. and Delta Air Lines, Inc. respectfully apply for the following authority to engage in scheduled, foreign air transportation of persons, property and mail in a new Mexico-US city-pair market:

  1. an exemption, pursuant to 49 USC § 40109 and for an initial period of one year, authorizing AeroMexico to operate such service in the Mexico City, Mexico-Ontario, California market;
  2. a statement of authorization, pursuant to 14 CFR Part 212 and of indefinite duration, permitting AeroMexico to display the DL* designator code of Delta on AeroMexico-operated flights in this market; and
  3. a codeshare exemption, for an initial period of two years, authorizing Delta to engage in such transportation in this city-pair market by placing its code on AeroMexico.

So that Delta may offer codeshare service on the route pursuant to its longstanding codeshare agreement with AeroMexico, the Joint Applicants also request codeshare exemption authority for Delta, and a statement of authorization authorizing AeroMexico to carry Delta’s code, in the market. Delta is fit, willing, and able to engage in these services on a codeshare basis, as it operates numerous US-Mexico transborder services under various exemptions and pursuant to Delta’s certificate authority for Route 901. See Order 2010-3-12.

Petition for Rulemaking - Limitation on Change Fees for International Flights

FlyersRights.org and the undersigned hereby petition the Department of Transportation to regulate change fees for foreign air transportation under 49 USC §§ 41501 and 41509.

In selectively exempting US and foreign air carriers from international passenger tariffs, the DOT acknowledged a continuation in the "evolution of a policy where we rely on market forces rather than continual government oversight to set prices for air transportation." In providing international passenger tariff exemptions, DOT affirmed that this would "not materially lessen [DOT's] ability to intervene in passenger pricing matters should it be necessary." Further, the DOT stated that it "has always had the statutory authority to take action directly against unfiled passenger fees and rules." DOT confirmed that under 49 USC §§ 41501 and 41509, air carriers engaged in foreign air transportation must "establish reasonable rates and rules" and that DOT has the authority to "cancel a rule that is unreasonable after notice and hearing." However, in the more than "34 years since the passage of the Airline Deregulation Act," DOT has "declined to use this authority to strike down fare rules in foreign air transportation."

DOT has the statutory authority to regulate fares and fees in foreign air transportation and is obligated to do so. While DOT has regulated extensively in analogous areas it has yet to promulgate rules concerning change fees in foreign air transportation.

Following the grant to the Republic of Azerbaijan of the category 1 status under the FAA IASA program, Silk Way hereby submits this Amendment to its docketed applications referenced above in order to update the evidentiary information contained in the applications and the exhibits thereto.

Silk Way requests a foreign air carrier permit authorizing it to engage in charter air transportation of cargo between any point or points in Azerbaijan and any point or points in the United States, as well as any point or points in the United States and any point or points in a third country or countries subject to pertinent national, bilateral and international rules and regulations. Silk Way plans to start its US operations as soon as the Department authorizes them.

Termination of Codesharing

On May 17, 2006, the Department of Transportation issued a blanket Statement of Authorization to US Airways, Inc. and TAP Air Portugal to display each other’s code, “US” and “TP,” respectively, on flights between the United States and Portugal, both non-stop and via intermediate points, and to third country points beyond the United States and beyond Portugal.

In accordance with the Conditions set forth in the Action, US Airways hereby advises the Department that the US Airways-TAP codeshare arrangement has been terminated effective immediately. Accordingly, US Airways and TAP will no longer place their respective designator codes on each other’s flights.
