By Order 2016-11-17, issued November 22, 2016, we directed all interested persons to show cause why we should not make final our tentative findings and conclusions stated therein and award an amended foreign air carrier permit in the form attached to the Order and subject to the conditions attached thereto. We gave interested persons 21 days to file objections to the Order. We said that if no objections were filed, all further procedural steps would be deemed waived, and the Department would enter an order (subject to Presidential review under 49 USC §41307) which would make final the findings and conclusions of the Order.

No objections were received within the time period provided.

I write in support of the application of Alaska Airlines for an allocation of slots at Mexico City's Benito Juarez International Airport to enable double-daily nonstop roundtrip scheduled air service between Los Angeles International Airport and Mexico City. I am very pleased that Alaska has proposed to introduce double-daily nonstop service to Mexico City from Los Angeles. I strongly urge the Department to award Alaska the MEX slots necessary to implement this service.

Complaint of Food Allergy Research & Education

Food Allergy Research & Education, the nation’s leading organization representing the rights of individuals with food allergies, through undersigned counsel, hereby files this formal complaint and requests that the Department of Transportation investigate and take immediate steps to bring American Airlines into compliance with its legal obligations pursuant to the Air Carrier Access Act. FARE is dedicated to improving the lives of individuals with food allergies. Therefore, FARE’s mission is directly impacted by American Airlines explicit and discriminatory policy of denying pre-boarding to individuals with food allergies and the people for whom it advocates are on a daily basis being denied their federally protected rights.

FARE requests that the Department of Transportation take immediate steps to address American Airlines’ blatant disregard for its legal obligations pursuant to the Air Carrier Access Act. Specifically, FARE seeks the following:

  1. a statement that American Airlines’ policies discriminate against individuals with food allergies;
  2. enforcement action to bring American Airlines into compliance with federal law;
  3. a full and complete retraction of the discriminatory policy in question both on its website and in practice, and an affirmative statement on its website that American Airlines will permit individuals with a disability, including those with food allergies, to pre-board to allow an opportunity to wipe down seating areas and be seated in a timely and safe fashion;
  4. mandated training to ensure American Airlines adopts a uniform approach to prevent its employees from continuing to apply discriminatory policies against those with allergies;
  5. any and all other relief that may be available including but not limited to assessment of civil penalties which are appropriate given American Airlines widespread, clear and flagrant violation of law, attorneys’ fees and costs.

DOT Response to Request of Airlines for America

This is in response to your January 27, 2017, correspondence requesting that the Department extend the implementation period for the provisions of the Enhancing Passenger Protections III Final Rule concerning codeshare disclosure requirements and prohibition of undisclosed flight display bias. The Department previously extended the compliance date from December 5, 2016, to February 15, 2017. The Department is further extending the compliance date of the provisions concerning codeshare disclosure requirements and prohibition of undisclosed flight display bias to March 17, 2017. We will continue to review this matter and the remaining issues identified in your January 27, 2017, letter.
