Final Order

We have decided to select United for the subject authority in this proceeding. The available Chicago‑San Jose del Cabo route right constitutes a valuable economic right obtained in exchange for granting Mexico route opportunities for its airlines to serve the United States, and the public interest calls for the prompt use of this right. If we had an opportunity to do so, we would approve the applications of both carriers to serve the Chicago‑San Jose del Cabo market. However, only one designation opportunity is available at this time.

American Airlines currently offers two weekly flights in the Chicago-San Jose del Cabo market. USA 3000 has received approval from the Department to conduct a public charter program in the Chicago-San Jose del Cabo market that appears identical to the services proposed in this proceeding (see Public Charter Number: PC-04-328).

This article indicates that 4 current employees of the company will be buying Casino Express with the help of the Avion Group. The Avion Group, see attached, is not a US Citizen as defined by the DOT, and reportedly is providing 90 percent financing and anywhere from 19 to 49 percent interest in the company.

As the new owners hold various required positions within the airline as required by the FAA, but not all of the required positions, is this a possible cause of undue influence on those required positions as some are now 'more equal' than others. The article implies a major expansion and change in authority.

I believe this change of ownership needs to be reviewed by the FAA and OST.

Reply of Consolidated Carriers | Word

The Consolidated Carriers oppose the requests of the Postal Service and Penair to set a single Part 121 rate, and also oppose the request of the Postal Service to include non-mail service in constructing mail service rates, and to reconsider the rate of return element previously set by the Department. Further, the Carriers request review of Order 2005-3-27 to extent necessary to include all carriers and routes covered by the standard Part 121 rate (or covered by any other rate subject to future negotiated rates) upon application by the carrier. The Carriers oppose any change in bush ratemaking methodology until two years after the Postal Service has issued a new P0-508 Procedures Manual documenting the requirements it imposes on participating carriers. Finally, the Carriers request the Department set to Part 135 wheel plane linehaul rate at $1,125,735 per ton mile, the Part 135 seaplane rate at $2,419,596 per ton mile, and the terminal charge applicable to all bush service at $950.54 per ton enplaned, and that these rates shall remain in effect until December 31, 2005, or further notice. The bush carriers should not be paid inadequate rates due simply to administrative delay.

Reply of United Air Lines to AirTran Airways Opposition

In opposing United's application, the arguments FL makes are essentially identical to claims it made in Docket OST-02-13527, where it is opposing an application USA 3000 Airlines filed to amend an exemption it holds to provide scheduled service between Baltimore and Cancun to include Washington, D.C. as a U.S, gateway. United has already responded to FL's arguments in pleadings it filed in Docket OST-02-13527, wherein United showed that FL's position is fundamentally inconsistent with longstanding Department precedent and utterly without merit --if not actually frivolous - in public interest and transportation policy terms,S Simply repeating unsound arguments in another docket, as FL has done, does not improve their standing.
