Privilege Style, a foreign air carrier of Spain, hereby applies for exemption authority and a foreign air carrier permit to conduct charter foreign air transportation of persons, property, and mail, between a point or points in the European Community and the Member States of the European Union, and a point or points in the United States, to the full extent allowed under the Air Transport Agreement between the United States and the European Community and the Member States of the European Union.

Privilege Style requests authority to engage in:

  1. foreign charter air transportation of persons, property, and mail from any point or points behind any Member State of the European Community via any point or points in any Member State and via intermediate points to any point or points in the United States and beyond;
  2. foreign charter air transportation of persons, property, and mail between any point or points in the United States and any point or points in any Member State of the European Common Aviation Area;
  3. foreign charter cargo air transportation between any point or points in the United States and any other point or points; and
  4. charter transportation consistent with any future, additional rights that may be granted to foreign air carriers of the Member States of the European Community.

Order Granting Exemption and to Show Cause

We grant the request of Privilege Style, S.A. for an exemption under 49 USC §40109 for the services:

  1. Foreign charter air transportation of persons, property and mail from any point or points behind any Member State of the European Union via any point or points in any Member State and via intermediate points to any point or points in the United States and beyond;
  2. Foreign charter air transportation of persons, property and mail between any point or points in the United States and any point or points in any member of the European Common Aviation Area;
  3. Foreign charter all-cargo air transportation between any point or points in the United States and any other point or points;
  4. Other charters pursuant to the prior approval requirements set forth in the Department’s regulations governing charters; and
  5. Charter transportation authorized by any additional route rights made available to European Community carriers in the future.

With respect to the applicant’s request for a foreign air carrier permit in this proceeding, we direct all interested persons to show cause why our tentative decision on that application, set forth above, should not be made final. Any interested person objecting to the issuance of an order making final our tentative findings and conclusions with respect to the applicant’s request for a foreign air carrier permit shall, no later than twenty-one calendar days after the date of service of this order, file with the Department.

Final Order

By Order 2010-9-15, issued September 10, 2010, we directed all interested persons to show cause why we should not make final our tentative findings and conclusions stated therein and award a foreign air carrier permit in the form attached to the Order and subject to the conditions attached thereto. We gave interested persons 21 days to file objections to the Order. We said that if no objections were filed, all further procedural steps would be deemed waived, and the Department would enter an order (subject to Presidential review under 49 USC §41307) which would make final the findings and conclusions of the Order.

Application of Privilege Style for a Statement of Authorization

Privilege Style, a foreign air carrier of Spain, hereby applies for a statement of authorization to display Delta’s code on Privilege Style flights operated on a wet lease basis for Air Europa Lineas Aereas, S.A.U. pursuant to Air Europa and Delta’s existing codesharing agreement.

Privilege Style will initially display Delta’s “DL*” designator code on Privilege Style wet lease flights between Madrid, Spain and Lisbon, Portugal pursuant to the existing codesharing agreement between Air Europa and Delta. Privilege Style will operate these flights with ERJ-145 aircraft, and intends to commence operations as soon as possible.

Department Action on Application

Application of Privilege Style, S.A. for a statement of authorization to permit it to display the (DL*) designator code of Delta Air Lines, Inc. on flights operated by Privilege Style on a wet lease basis for Air Europa Lineas Aereas, SAU, pursuant to the existing code-sharing agreement between Air Europa and Delta.l The applicant also requests a waiver of the 45-day advance filing requirement under 14 CFR Part 212.

Delta and Air Europa hold reciprocal statements of authorization that permit Delta to display Air Europa's (UX*) designator code on flights operated by Delta and Air Europa to display Delta's (DL*) designator code on flights operated by Air Europa in conjunction with foreign air transportation of persons, property and mail on flights (a) between any point or points in the US and any point or points in the EU (on a nonstop basis and via intermediate routings); (b) between any point or points in the US and any other point or points in the European Common Aviation Area; (c) between US points; (d) between points in the EU; (e) beyond the EU to any point or points; and (f) beyond the US to any point or points. Privilege Style, a foreign air carrier of Spain, hereby applies for a statement of authorization (1) for a long term wet lease of one Boeing 767-300 aircraft to Air Europa Lineas Aereas, SAU, a foreign air carrier of Spain, from June 1 to October 31, 2014, and (2) to display Delta’s “DL*” designator code on the above flights between Madrid, Spain and New York (JFK) pursuant to Air Europa and Delta’s existing codesharing agreement.

Privilege Style holds Department authority to display Delta’s code on flights between Madrid, Spain and Lisbon, Portugal, as well as all previous codeshare points included in the August 26, 2011 Joint Application of Delta and Air Europa filed in Docket OST-2011-0160. See Department Action on Application in Dockets OST-2010-0148 and OST-2011-0160 (January 30, 2013).

Notice of Cessation of JFK-Madrid Wet-Lease/Codeshare Services

Air Europa Lineas Aereas, S.A.U. hereby notifies the Department that Air Europa and Privilege Style, S.A. have ceased the wet-lease/codeshare services between New York (JFK) and Madrid, Spain, authorized by the Notice of Action Taken issued May 6, 2014 in the above dockets. This notification is given pursuant to condition (b) of the May 6 Notice.

This notification does not affect the continuing codeshare services involving Air Europa and Delta Air Lines, Inc. authorized by the Department’s Notice dated September 21, 2011 in Docket OST-2011-0160. Nor does it affect the continuing intra-Europe wet-lease/codeshare services involving Air Europa, Delta and Privilege Style authorized by the Department’s Notice dated January 30, 2013, in the above dockets.
