OST-00-7292 - Delta and Aeromexico - Los Angeles- Durango; Atlanta- Merida

Hereby applies for renewal of exemptions authorizing Delta to continue to provide scheduled foreign air transportation of persons, property and mail between Atlanta, Georgia, on the one hand, and Leon, San Jose del Cabo and Merida, Mexico, on the other hand, and to continue to combine such exemption authority with all of Delta's existing certificate and exemption authority, to the extent permitted by international agreements. The June 20, 2000 Notice of Action Taken also granted Delta exemption authority for the Los Angeles-Durango route. Delta is not seeking renewal of that authority.

Although Delta is not currently providing Atlanta-Providenciales service, Delta is seeking renewal of its exemption authority to provide Delta with the flexibility to reinstate service as market conditions warrant. Renewal of Delta's exemption authority is in the public interest and is consistent with the rights available to U.S. carriers under the U.S.-U.K. Air Services Agreement, as amended.

The U.S.-Mexico transborder exemption authority granted to Delta in the captioned dockets is subject to the dormancy notice requirements set forth in condition 7 of Appendix A of Order 88-10-2. With the exception of the U.S.-Mexico exemption authority granted in Dockets OST-2001-10457, OST-2000-7390, and OST-2000-7022, the U.S.-Mexico exemption authority granted is limited to services provided on a code-share basis only.

Delta does not seek to renew the Los Angeles-Durango exemption authority originally granted in this docket (see Notice of Action Taken dated June 20, 2000). Delta provides seasonal service in the Atlanta-San Jose del Cabo market.
