Application for Renewal of an Exemption
This service is an integral part of Uniteds service offering in the Caribbean and Latin America. The ALM code-share flights offer passengers convenient United on-line service to points served by ALM in this area, including Bonaire. United and ALM have coordinated their schedules at Miami and provide one-stop check-in services to assure convenient connecting services to Bonaire as well as the other points where code-share services are offered.

Renewal of United's Miami-Bonaire authority is consistent with the public interest. Although United's initial exemption application in this docket to serve Bonaire was granted on the basis of comity and reciprocity, these code-share services are now specifically contemplated by the Open Skies Agreement governing air services between the U.S. and the Netherlands Antilles, which was initialed on December 9, 1997, and entered into force on July 14, 1998. This code-share authority allows United to extend its network of on-line services to Bonaire, which has no other U.S.-flag service. In the case of Curacao and Port-au-Prince, which are served as coterminals with Bonaire, United's code share with Air ALM offers a valuable service alternative to the on-line services of American, which is the dominant carrier in the U.S. -Caribbean market. The code-share arrangement is, therefore, pro-competitive and increases the U.S. -Caribbean service options available to U.S. passengers.

By Notice of Action Taken, dated September 21, 1999, the Department renewed the exemption authorizing United to operate scheduled combination service between Miami, Florida and Bonaire, Netherlands Antilles, pursuant to a code-share arrangement with Air ALM; to integrate its Miami-Bonaire service with its authority on Routes 57 and 632 and other existing authority;' and to coterminalize its Bonaire services with services to Curacao, Aruba, and Port-au-Prince. United's exemption authority was granted on September 21, 1999, for a period of two years, and is currently set to expire on September 21, 2001.
These
code-share services are specifically contemplated by the Open Skies Agreement
governing air services between the U.S. and the Netherlands Antilles, which was
initialed on December 9, 1997, and entered into force on July 14, 1998. This
code-share authority allows United to extend its network of online services to
Bonaire, which has no other U.S. flag service. (OAG, Worldwide Ed., July 2001).
In the case of Curacao and Port-au-Prince, which are served as coterminals with
Bonaire, United's code share with Air ALM offers a valuable service alternative
to the online services of American Airlines, which is the dominant carrier in
the U.S.-Caribbean market. The code-share arrangement is, therefore,
pro-competitive and increases the U.S.-Caribbean service options available to
U.S. passengers.

By Notice of Action Taken, dated August 6, 2001, in Docket OST-95299, the Department renewed an exemption authorizing United to operate scheduled combination service between Miami, Florida and Bonaire, Netherlands Antilles, pursuant to a code-share arrangement with ALM 1997 Airline N.V., and amended that exemption to authorize United to integrate its Miami-Bonaire service with its authority on Routes 57 and 632 and other existing authority and to co-terminalize its Bonaire services with services to Curacao, Aruba, and Port-au-Prince. The exemption authority, as amended, is currently effective through August 6, 2003. United requests that this exemption authority be renewed for a minimum period of two years.
On January 11, 2002, United notified the Department that its codeshare arrangement with Air ALM was terminated. However, United would like to renew its exemption, so that it may utilize this authority to serve Miami-Bonaire with another code share partner in the future. Renewal of this authority would give United the flexibility to quickly start services with a new code-share partner. This service would increase options for passengers in the U.S,-Caribbean market.
The Department's last renewal notice refers to United's "intention" to offer this service under its arrangement with Air ALM. As United reads the notice, it is broad enough to allow United to offer service under a code-share arrangement with a carrier other than Air ALM or to operate service in its own aircraft. To the extent necessary, and for avoidance of doubt, United requests that its exemption, as renewed, allow it to code share with any authorized carrier or to operate services in its own aircraft.

United Air Lines, Inc. hereby applies for renewal of an exemption from 49 U.S.C. § 41101 authorizing it to provide scheduled foreign air transportation of persons, property, and mail between Miami, Florida and Bonaire, Netherlands Antilles and to co-terminalize its Bonaire services with services to Curacao, Netherlands Antilles, and Port-au-Prince, Haiti. The exemption authority, as amended, is currently effective through April 27, 2007. Untied requests that this exemption authority be renewed for a minimum period of two years.
