Application for Exemption

ICC International Cargo Charters Canada Ltd., doing business as ICC Canada Ltd. ("ICC Canada"), a Canadian corporation, respectfully requests an exemption from the provisions of 49 U.S.C. § 41301 to the extent necessary to permit it to engage in charter foreign air transportation of property and mail between a point or points in Canada and a point or points in the United States. ICC Canada also seeks authority to operate fifth freedom cargo charters between the U.S. and third countries subject to Part 212 of the Department's Economic regulations. ICC Canada requests the exemption for a period of one year. As ICC Canada desires to begin operations to the United States as soon as possible, it requests that the Department expedite processing of this exemption application.

ICC Canada proposes to commence U.S.-Canada charter all-cargo service using the Airbus A-300 aircraft identified in this exhibit. ICC Canada believes that there is a significant demand for charter all-cargo service in the U.S.-Canada trans-border market. ICC Canada plans to begin by operating flights five nights per week between Calgary and Dayton, Ohio under a contract with a U.S. freight forwarder.

Although ICC recently suspended all operations, ICC had been successfully been operating Canada-U.S. charter cargo services since November 1998. ICC continues to be fit, willing, and able to operate the services referred to herein. ICC is in the process of refleeting and will be applying for Ops Specs with these new aircraft (B-727's and/or B-757s) in the near future.

Correspondence from McMillan Binch LLP, informing the Department that ICC International Cargo Charters Canada, Ltd. d/b/a ICC Canada, Ltd., does not hold the necessary Canadian licence to operate non-scheduled international service with all-cargo aircraft, and submitting for Department records, Decision No. 50-A-2003 issued by the Canadian Transportation Agency on January 31, 2003, in support of that information.

Reply of ICC International Cargo Charters

CTA, Transport Canada, the Department and the FAA were all advised that ICC Canada was temporarily suspending operations as the A-300's were removed from service and as the airline re-fleeted. None of ICC Canada's underlying economic authority has been cancelled or revoked, and there has, therefore, been no "factual error" by ICC Canada herein.
