Notice - Foreign Carriers

This is to advise foreign air carriers serving the United States that the Vision 100‑Century of Aviation Reauthorization Act (P.L. 108‑176, 117 Stat. 2490, December 12, 2003) amends 49 U.S.C. § 41313(c) to require, among other things, that foreign air carriers submit to the Department and the National Transportation Safety Board additional assurances for their respective plans to address the needs of families of passengers involved in aircraft accidents. The content and filing requirements for the update to the plans applicable to foreign air carriers are set forth in section 809 of Vision 100. A copy of section 809 is attached.

The additional assurances required to be submitted are described in paragraph (b) of section 809 of Vision 100. In accordance with paragraph (c), foreign air carriers must submit their updated plans to the Department and the NTSB within 90 days of the statute's enactment. Since Vision 100 was signed into law on December 12, 2003, updated plans are due to be filed not later than March 11, 2004. Plans should be submitted to the Department and the NTSB

In this order we exempt foreign air carriers which currently hold, or may subsequently receive, Department authority to conduct operations in foreign air transportation using only small aircraft, from the provisions of 49 U.S.C. section 41313.

This refers to your letters of May 20, concerning the applicability of the Foreign Air Carrier Family Support Act of 1997 (PL 105-148) to certain classes of foreign air carriers. In those letters, you stated your view that, in the following two examples, a foreign air carrier need not file, under the provisions of the Act, a plan to address the needs of families of passengers involved in an accident:

1 . A new-entrant foreign air carrier from a country whose homeland holds a Category 11 rating from the Federal Aviation Administration under its International Aviation Safety Assessment (IASA) Program, and holds effective Department authority to conduct U.S. operations only using aircraft wet-leased from a duly authorized and properly supervised U.S. or foreign air carrier; and

2. A foreign air carrier from a country whose homeland holds a Category I rating from the FAA, which holds effective Department economic authority to conduct U.S. operations using its own aircraft and crews, that elects, at its option, not to obtain operations specifications from the FAA, but to operate only using wet-leased aircraft.

It is our view that the foreign air carrier described in example 1 above does not need to file a plan, but that the foreign air carrier described in example 2 does.

This is to advise certificated air carriers that the Wendell H. Ford Aviation Investment and Reform Act for the 21st Century (AIR-21) amends 49 U.S.C. 41113(b) to require, among other things, that certificated air carriers submit to the Department and the National Transportation Safety Board additional assurances for their respective plans to address the needs of families of passengers involved in aircraft accidents. Under the section, certificated air carriers must submit their updated plans to the Department and the NTSB within 180 days of the statute's enactment. Since AIR-21 was signed into law on April 5, 2000, updated plans are due to be filed not later than Monday, October 2, 2000.
