FWIA respectfully requests two additional weekly frequencies in the U.S.-Peru market. With the peak U.S.-Peru cargo season about to commence, FWIA would start using the third weekly frequency within just two weeks and the fourth frequency shortly thereafter.

The late filing is the result of error by counsel; Arrow was in no way responsible for the error. Arrow's application was prepared without either counsel or client having seen any other party's filing. Arrow herein applies for an allocation of five additional weeklyall-cargo frequencies in the U.S.-Peru market, for a total of seven weekly frequencies.

Arrow has requested an allocation of five additional weekly allcargo frequencies in the U.S.-Peru market, which would give it a total of seven. Challenge requested an additional two weekly frequencies, which would bring its total to seven. Fine applied for a U.S.-Peru all-cargo exemption and requested an allocation of five weekly frequencies. Florida West, which currently is allocated two weekly frequencies, requested allocation of two additional weekly frequencies. Thus, of the total 33 frequencies available, only 14 frequencies have been applied for. These modest requests would seem to present no decisional problems to the Department, at least insofar as the allocation of available frequencies is concerned. Arrow air, Inc. respectfully requests that the Department expeditiously allocate to it five additional weekly U.S.-Peru allcargo frequencies as requested.

It bears reiteration that approval of Fine Air's application is the most constructive single step the Department can take to secure Fine Air's reinstatement and alleviate the bilateral tensions that result from continued maintenance of Peru's ban. It is entirely consistent with the position taken by the, Department in bilateral negotiations with the Peruvians to date -- namely, that it is time for the Peruvian Government to lift its ban and admit Fine Air to the U.S.-Peru market. Awarding Fine Air the U.S. authority necessary to do so is, we submit, a vital affirmation of, and demonstration of the Department's commitment to, this position.

Pursuant to the U.S.-Peru aviation agreement, there are no frequency limitations for all-cargo services after June 11, 1999. In granting authority consistent with the bilateral agreement, we point out that (1) through December 11, 1998, U.S. carriers may operate all-cargo services on routes between the United States and Peru via any intermediate point or points, excluding points in Mexico, Venezuela, and Colombia (except Bogota); and (2) through June 11, 1999, when operating all-cargo services beyond Peru, U.S. carriers may not carry local traffic between Peru and Argentina, Bolivia, Chile, Brazil, Paraguay, or Uruguay.

Fine Air Services, Inc. respectfully requests that the Department of Transportation renew for a period of not less than two (2) years Fine Air's exemption authority to engage in scheduled foreign air transportation of property and mail between points in the United States and points in Peru via all intermediate, and to all beyond points permissible under the aviation agreement between the United States and Peru, and which Fine holds authority to serve and to integrate this authority with its existing exemption and certificate authority to the extent consistent with all relevant bilaterals. In the alternative, Fine Air requests such other, further or different relief as the Department may deem necessary and proper.
