Grant of this application would enable ANZ and Lufthansa to conduct code-share services consistent with the U.S.-New Zealand and U.S.-Germany Open Skies Agreements. Approval of this application will also enable ANZ and Lufthansa to respond quickly to service demands and changes in the marketplace, as it will provide the carriers with the flexibility to adjust their code-share services without the need to obtain Department approval to amend their code-share authority every time they seek to add another third-country beyond point.

Air New Zealand and Lufthansa ask the Department for expeditious issuance of blanket Statements of Authorization even though the Department has yet to grant Northwest and KLM's long-pending application. It would be grossly unfair to both Northwest and KLM, and seemingly indefensible as a matter of policy and procedure, for the Department to grant the application of Air New Zealand and Lufthansa before granting the application of Northwest and KLM. This situation is particularly inexplicable because the Northwest-KLM code-share alliance was implemented years before Air New Zealand's alliance with Lufthansa was implemented and the underlying U.S.-Netherlands open skies agreement was signed years before the United States signed its open skies agreements with New Zealand and Germany. Furthermore, ill is reasonable to expect the Department to act on a long-pending application filed by a U.S. carrier before it acts on a similar but new application filed by two foreign carriers; as Lufthansa and Air New Zealand point out, U.S. interest in their application "is more remote than its interest in U.S. carrier/foreign carrier arrangements."

The Northwest-KLM alliance (and the carriers' grant of antitrust immunity) is under review by the Department, unlike the ANZ-Lufthansa code-share operations. The proposed ANZ-Lufthansa code-share services will merely transit the United States: ANZ and Lufthansa are not seeking authority at this time to market these codeshare services to U.S.-originating or -destined travelers. The Joint Application seeks immediate authority from the Department to inaugurate new code share services this spring between Auckland and Frankfurt via Los Angeles, the Northwest-KLM application, at the time of its filing, did not seek any authority for specific new services. In fact, the situation is exactly the reverse of what Northwest and KLM claim. What would be "grossly unfair'' would be for the Department to hold the Joint Application hostage until it decides the Northwest-KLM application.

Pursuant to the Statement of Authorization granted on June 2, 1999 in Docket OST 99-5460, Air New Zealand Limited notifies the Department that it will carry the designator code of Lufthansa on Air New Zealand’s Auckland-Nadi-Los Angeles-Frankfurt services commencing November 23, 2000. Lufthansa will hold out Frankfurt-Auckland services on these flights with stopover rights at Los Angeles and Nadi. Lufthansa will not otherwise be offering Los Angeles-Nadi or Nadi-Auckland services.

Pursuant to condition (b) of the Department's Action dated June 2, 1999, in this docket, Lufthansa German Airlines hereby gives notice that Lufthansa will display the Air New Zealand "NZ" designator code on flights operated by Lufthansa between Los Angeles and Munich, effective March 25, 2001. Using this code share, Air New Zealand will hold out services in the New Zealand-Munich market.

Air New Zealand will offer code-share service between Germany and the U.S. and between the U.S..and New Zealand and points beyond New Zealand in connection with the above flights.

Pursuant to the Department's approval of the blanket statements of authorization in the above-referenced proceeding, Air New Zealand and Lufthansa Cargo hereby notify the Department that Lufthansa Cargo's "LH" designator code will be placed on Air New Zealand flights operating on the following routes, effective December 10, 2001:

Lufthansa Cargo will use these code-share services to transport cargo shipments between Germany and Auckland; a limited amount of capacity will be made available by Lufthansa Cargo on a fifth freedom basis to shippers in the Los Angeles-Auckland market. (Lufthansa Cargo will not hold out service to or from Rarotonga or Papeete.)

Lufthansa and Air New Zealand

Pursuant to the Department's approval of the blanket statements of authorization in the above-referenced proceeding, Lufthansa Cargo and Air New Zealand hereby supplement the notification submitted to the Department on March 7, 2001 concerning the placement of Air New Zealand's "NZ" designator code on Lufthansa Cargo's around-the-world freighter services.

Among the code share points notified to the Department on March 7, 2001 were Lahore and Karachi, Pakistan. In the aftermath of the attacks of September 11 and due to the resulting increased security concerns, Lufthansa Cargo was required on short notice to discontinue freighter service to both Karachi and Lahore. In an effort to ensure continuity of service for customers using its around-the-world services, Lufthansa Cargo, on an interim basis, has substituted Delhi and Sharjah for these cities on its around-the-world services. In addition, Lufthansa Cargo has included Atlanta and Honolulu as points on its around-the-world routings in an effort to increase the commercial viability of its services in the new environment

The current routings for Lufthansa Cargo's around-the-world freighter services are as follows:

Air New Zealand continues to offer code-share service between Germany and the U.S. and between the U.S. and New Zealand and points beyond New Zealand (with the exception of Delhi and Sharjah) in connection with the above flights.

Pursuant to the blanket statement of authorization issued in this docket, Air New Zealand and Lufthansa hereby notify the Department that, commencing June 30, 2004, they will begin reciprocal code‑sharing on San Francisco flights. Air New Zealand will carry Lufthansa's designator code on its flights between Auckland and San Francisco, and Lufthansa will carry Air New Zealand's code on Lufthansa's flights between San Francisco and Munich and San Francisco and Frankfurt.
