June 3, 1999 Answer of North American Airlines Exemption and Statement of Authorization to Wet Lease to Guyana Airways - New York-Georgetown

On May 6, 1999 North American, which formerly operated U.S.-Guyana flights for Guyana Airways Corporation, the Applicant's predecessor airline company, applied to the Guyana Government for authority to operate charter flights between New York and Guyana, with a projected start date of June 24, 1999. North American plans to operate three roundtrips with Boeing 757-200 aircraft in the Summer season, dropping to as- few as one roundtrip in the Winter, depending on seasonal market conditions.  The necessary final approval by the Guyana Cabinet has not been granted. North American was led to believe that the Cabinet would consider North American's application on May 25, and then on June 1, but the Cabinet still has not acted on the application. The Cabinet does not meet again until June 8, 1999. As a result of this delay, North American has already been forced to cancel its initial two trips to Guyana and would be unable to start operations before July 1, 1999 if the authority were approved next week.

On June 15, 1999, North American Airlines, Inc. filed a letter in the docket amending its June 3, 1999 Answer and purporting to correct one of its factual representations. North American now no longer alleges that either Mr. Mekdeci's or one of his companies holds a monopoly on key pieces of ground handling equipment in Guyana. North American now alleges that it is Guyana Airways 2000, Inc. which holds this monopoly. However, once again North American's allegation (as amended) is false and incorrect and, once again, its source should be questioned. As the attached listing of ground equipment demonstrates, a number of carriers, including a U.S. carrier, operate their own equipment at Georgetown, Guyana. In fact, the majority of the equipment at GEO is operated by BWIA which is currently the only combination carrier providing U.S.-GEO scheduled service. The New Guyana Airways respectfully submits the North American's continuing objection to its re-initiation of scheduled services, using the vehicle of Nordstress' wet lease application, is being interposed by former GAC employees to prevent the resumption of scheduled flag service by the newly-privatized GA2000. The A-300-600 is on the ground waiting to start scheduled operations on behalf of GA2000 in the vitally needed New York -Georgetown scheduled market.

On June 3, 1999, North American Airlines, Inc. filed an Answer in objection to a May 28, 1999 Application of Nordstress Australia Pty. Limited to wet lease to Guyana Airways 2000, Inc. Because North American's objection is aimed at GA2000, and not at Nordstress, and only GA2000 can properly respond to the matters raised by North American, GA2000 requests leave to file the instant reply.  New Guyana Airways submits that the objection of North American against the application for Nordstress Australia, Pty. Limited is in fact one against the new Guyana Airways and is effectively being improperly interposed by former employees of GAC to prevent the resumption of scheduled flag service by the newly-privatized GA2000. GA2000 respectfully submits that this wet lease be approved to permit the reinstitution of vitally needed scheduled. flag service between New York and Georgetown.

Exemption from 49 U.S.C. § 41301, and statement of authorization under 14 CFR Part 212, to the extent necessary to permit it to wet lease aircraft on a long-term basis to Guyana Airways 2000 on its proposed services between Georgetown and New York.

Basis for approval: Comity and reciprocity with Guyana and Australia. With respect to the concerns expressed by North American over the status of its request to conduct Guyana-New York charters, we note that by diplomatic note dated June 22, 1999, Guyana’s Ministry of Foreign Affairs advised that it "has no objection to simultaneous reciprocal approval of the GA2000/Nordstress application and the North American Airlines Inc. application being granted by the relevant authorities of both the Cooperative Republic of Guyana and the United States of America." In light of this intergovernmental communication, we are granting Guyana Airways 2000’s request with the expectation that the Government of Guyana will likewise approve North American’s request. With respect to North American’s concern over the provision of ground handling services at Georgetown, we have no indication that these services are being provided on other than a fair and equitable basis. Finally, with respect to the answers filed by the two private parties, we note, upon a careful review of the record, that the pleadings do not provide adequate justification to warrant withholding the authority requested by Guyana Airways 2000.

August 9, 1999 Application for Extension of Exemption Authority and Statement of Authorization Wet Lease to Guyana Airways (New York-Georgetown)

Pursuant to 49 U.S.C. section 40109, Nordstress Australia Pty. Limited applies for an extension of its exemption authority and statement of authorization granted on June 29, 1999 to wet lease aircraft to Guyana Airways 2000. By Notice of Action Taken the Department granted such authority to Nordstress only for sixty days until August 29 and deferred action on the remainder of its application. Nordstress requests extension of its authority to June 29, 2000, coinciding with the term of the underlying operating authority granted to Guyana Airways 2000.  The Department restricted the term of authority granted to Nordstress presumably to make the wet lease operation contingent on resolution of the concern of North American Airlines, Inc. about securing operating authority from the Government of Guyana. Nordstress understands that North American has received its approval and has commenced operations.
