American Airlines, Inc., under 49 USC 40109, hereby applies for an exemption from the condition in its certificate for Route 804 (Miami -Medellin), issued by Order 2001-5-26, May 24, 2001, stating that service may commence no earlier than October 1, 2002. By this application, American seeks to accelerate the start-up date to June 1, 2002. The October 1, 2002 date was placed in American's certificate based on an understanding and amendments to the 1956 U.S.-Colombia Air Transport Agreement that entered into force through a November 27, 2000 Exchange of Notes between the two governments. Under the understanding and amendments, the authority awarded to American (including seven associated weekly frequencies) is available on October 1, 2002. See Notice, U.S.-Colombia Scheduled Combination Service Opportuni­ties, OST-2001-8910, February 16, 2001.

Pursuant to a Diplomatic Note dated February 6, 2002, American understands that the Government of Colombia is now willing to allow service to commence on June 1, 2002. In these circumstances, the Department should grant an exemption authorizing the accelerated start-up date. Such an exemption is clearly in the public interest, as it will facilitate important new service for passengers and shippers at an earlier date, enhancing competition and conveniencing the public.

Notice of Action Taken Miami- Medillin, Colombia

Exemption from Order 2001-5-26; start-up date: Under the terms of the 2000 aviation agreement between the U.S. and Colombia, U.S. carriers may provide services between any point or points in the United States and Barranquilla, Bogota, Cali, Cartagena and Medellin. The rights to provide air services to, from, and beyond Medellin are not effective until October 1,2002. By Order 2001-5-26, the Department awarded American certificate authority and an allocation of seven weekly frequencies to operate services in the Miami-Medellin market beginning no earlier than October 1,2002. Pursuant to a Diplomatic Note, the Government of Colombia has agreed to permit service to Medellin beginning June 1, 2002. American seeks relief from the condition in its certificate and frequency award so as to accelerate the start-up of its Miami-Medellin service to June 1, 2002.

OST-02-11620 August 9, 2002 Motion for Amended Dormancy Condition Miami-Medellin Service (Route 804)

American began Miami-Medellin service on June 1, 2002 five days a week, and will operate daily service effective October 1, 2002. But under the Notice of Action Taken in this docket on March 7, 2002, the 90-day dormancy period began on June 1, 2002 for all seven frequencies, and thus will end on August 30, 2002 even with respect to the two frequencies that American cannot use until October 1, 2002.

In these circumstances, there is good cause to grant American's request to amend the dormancy condition for two of its Miami-Medellin frequencies, so that the 90-day dormancy period for these two frequencies begins on October 1, 2002. Absent such relief, the two frequencies would expire on August 30, 2002, prior to their effective date. We urge the Depart­ment to grant the requested relief on an expedited basis to prevent such an anomalous result.

These frequencies were subject to a dormancy condition that any frequencies not used for a period of 90 days (after they become available on October 1, 2002) will revert automatically to the Department for reallocation. On February 19, 2002, American sought relief from the condition in its certificate and frequency award so as to accelerate the startup of its Miami-Medellin service to June 1, 2002, citing a Diplomatic Note from the Government of Colombia. On March 7, 2002, the Department granted American an exemption to accelerate the start-up date for all seven of its frequencies to June 1, 2002. However, it has now become clear that under the terms of the Diplomatic Note, only five of the seven frequencies would become effective on June 1, 2002, while the remaining two would become effective on October 1, 2002.   Under the terms of the March 7 Notice of Action Taken, the frequencies would expire August 30, 2002, if American did not begin service. American began Miami-Medellin service on June 1, 2002, with five weekly flights. American now seeks a waiver from dormancy condition for the other two frequencies, until October 1, 2002.
