El Al plans to commence Tel Aviv-Toronto-Los Angeles service, and the Joint Applicants plan to commence Los Angeles-Toronto codeshare service on or about April 1, 2002, and request that this application be granted by no later than March 12, 2002. The Joint Applicants request that the statement of authorization be effective for an indefinite term, subject to the Department’s usual conditions. El Al requests that its exemption authority remain effective for a period of at least two years.

On or about April 1, 2002, El Al plans to introduce scheduled one-stop single-plane service between Los Angeles and Tel Aviv via Toronto with full traffic rights, as authorized by the ad referendum agreement between the Governments of the United States and Israel signed on January 10, 2001. Pursuant to the Joint Applicants’ codesharing agreement, which was previously submitted to and approved by the Department in Docket OST-2001-8772, Delta plans to display its designator code on the Los Angeles-Toronto (and vice versa) segment of El Al’s flights. Delta will independently market and sell such transborder services to its customers.

(1) Exemption from 49 U.S.C. 41301 to permit El Al Israel Airlines to conduct scheduled foreign air transportation of persons, property and mail between Tel Aviv, Israel, and Los Angeles, CA, via the intermediate point Toronto, Canada, with full traffic rights.

(2) Statement of authorization pursuant to 14 CFR 212 of the Department's regulations to permit El A 1 Israel Airlines to display Delta's designator code on flights operated by El A1 between Los Angeles and Toronto.

Provide scheduled foreign air transportation of persons, property and mail between Tel Aviv, Israel and Los Angeles via the intermediate point Toronto, Canada with full traffic rights pursuant to a code-share arrangement with Delta Air Lines Inc.  Under this arrangement the “DL” designator code is displayed on flights operated by El Al between Toronto and Los Angeles.

Pursuant to Codeshare Condition (b) attached to the Notice of Action Taken dated March 18, 2002 in the above-referenced Docket, Delta Air Lines hereby notifies the Department that its designator code will no longer be displayed on flights operated by El Al Israel Airlines between Los Angeles, California and Toronto, Canada.
