Applies under 49 U.S.C. § 40109 and Rule 302 of the Department's Rules of Practice for an exemption from 49 U.S.C. § 41101 authorizing Northwest to provide scheduled foreign air transportation of persons, property and mail between Atlanta and Sao Paulo, Brazil; Bogota, Colombia; Cancun, Guadalajara, Mexico City, Monterrey and San Jose del Cabo, Mexico; and Lima, Peru; between Cincinnati and Cancun; and between Los Angeles and Guadalajara; and to combine the authority requested herein with Northwest's other certificate and exemption authority.' Northwest intends to use this authority to code-share with Delta Air Lines, Inc. and requests that the authority be issued on an expedited basis for a period of no less than two years.

Northwest requests renewal of this authority in order to offer services under a code-share arrangement with Delta Air Lines, Inc.  whereby Northwest places its code on flights operated by Delta.

(Delta), whereby Northwest places its “NW*” code on flights operated by Delta in the captioned markets.  Northwest states that it requests renewal of the Atlanta-Monterrey authority in order to continue to offer service under a code-share arrangement with ASE Atlantic Southeast (a Delta affiliate), whereby Northwest places its “NW*” code on flights operated by ASE Atlantic Southeast in the Atlanta-Monterrey market.

Application for an Amended Exemption

Northwest hereby applies for an amendment to its exemption in the above-captioned docket, so as to permit Northwest to codeshare on Delta and/or Delta Connection operated flights on the following routes, effective on the dates indicated:

  1. Atlanta, Georgia – Leon, Mexico* Dec. 1, 2006
  2. Los Angeles, CA, to/from the following points in Mexico:
    Acapulco - December 15, 2006
    Cancun - December 15, 2006
    Culiacan* - January 6, 2007
    Guadalajara - December 15, 2006
    Hermosillo* - February 1, 2007
    La Paz* - December 15, 2006
    Loreto* - December 18, 2006
    Manzanillo* - January 16, 2007
    Mazatlan* - December 22, 2006
    Puerto Vallarta - December 15, 2006

Routes denoted by “*” are currently planned for operation by Atlantic Southeast Airlines; Northwest requests flexibility to use its exemption authorization for the services operated by Delta and/or Delta Connection carriers on the subject routes.

Northwest also requests a codeshare-only designation for the listed routes to/from Mexico.

Northwest requests that all of its U.S.-Mexico authorities be issued with the Department’s standard 90 day dormancy condition to run from the proposed start date of each service, specifically including Zihuatanejo, which will begin slightly more than 6 months from today’s date. For ease of administrative efficiency, Northwest requests that its amended exemption authority be granted coextensive with the October 4, 2007 expiration date of the other U.S.- Mexico codeshare exemption authorities in this docket. (See, Petition of Northwest dated July 18, 2006, Docket OST-2006-25251; Answer of Northwest dated July 18, 2006, Docket OST-2006-24984.)

Amended exemption in this docket under 49 U.S.C. 40109 to: Add additional U.S.-Mexico transborder routes that will be served pursuant to a code-share arrangement, whereby Northwest will place its NW* code on (1) flights operated by Delta Air Lines, Inc., on the following routes: between Los Angeles, California, on the one hand, and Acapulco, Cancun, Guadalajara, Puerto Vallarta, and Zihuatanejo, Mexico, on the other hand; and (2) flights operated by Atlantic Southeast Airlines, as a Delta Connection carrier, between Atlanta, Georgia, and Leon, Mexico, and between Los Angeles, California, on the one hand, and Culiacan, Hermosillo, La Paz, Loreto, Manzanillo, Mazatlan, Torreon, and Zacatecas, Mexico, on the other hand. Northwest also requests authority to combine this exemption with all of Northwest's existing certificate and exemption authority, consistent with applicable international agreements. Northwest requests that its amended exemption authority be granted coextensive with the October 4, 2007, expiration date of the other U.S.-Mexico code-share exemption authorities in this docket.

Northwest informally advised us that, while its application referred to Delta Connection Carriers (application at 1, footnote 1), in fact the only Delta Connection carrier it intends its application to encompass is ASA. Northwest also advised us informally that it recognizes that it can only code-share on routes where the direct carrier holds the necessary underlying economic authority. In setting forth Northwest's request here, we have taken into account the informal advice provided by the applicant.

Hereby requests a renewal of its exemption from 49 U.S.C. § 41101 authorizing Northwest to offer scheduled foreign air transportation of persons, property and mail on flights operated by Delta Air Lines, Inc. between: Atlanta, Georgia on the one hand, and Sao Paolo, Brazil; Bogota, Colombia; Cancun, Mexico; Guadalajara, Mexico; Leon, Mexico; Mexico City, Mexico, Monterrey, Mexico; San Jose del Cabo, Mexico; and Lima, Peru, on the other hand; Cincinnati, Ohio, and Cancun, Mexico; and Los Angeles, California on the one hand, and Acapulco, Mexico; Cancun, Mexico; and Guadalajara, Mexico, on the other hand.

Northwest was previously issued exemption authority to operate codeshare services operated by ASA between Los Angeles and various points in Mexico.  Northwest is not currently offering those codeshare services, and ASA has been replaced on these Los Angeles-Mexico routes by ExpressJet. Northwest therefore requests new or amended exemption authority' to enable Northwest to offer codeshare service on routes operated by ExpressJet between Los Angeles and the following points in Mexico:

Northwest states that it will use this authority to serve the markets pursuant to a code-share arrangement with ExpressJet Airlines, in lieu of ASA/Delta, whereby Northwest will place its "NW" code on the flights of ExpressJet on those routes.

Northwest explains that, although it had previously advised that it would operate these code-share services with other carrier(s), (see Notice of Action Taken dated November 9, 2006, in the present Docket), it will replace the subject services with those of ExpressJet. Northwest states that, in this regard, Northwest expects to display its code on the ExpressJet's flights within one year of the date of this application (i.e., no later than August 3, 2008). We note here that, according to Northwest's application, it will serve the Los Angeles-Acapulco market pursuant to a code-share arrangement with both Delta and ExpressJet.

Scheduled foreign air transportation of persons, property, and mail between Atlanta, Georgia, and Leon/Guanajuato, Mexico. Northwest states that it will use this authority to serve the market pursuant to a code-share arrangement with both ASA and Shuttle America Corporation (Shuttle America), in lieu of Delta,  whereby Northwest will place its "NW" code on the flights of ASA and Shuttle on that route.

New exemption authority for two years:

Scheduled foreign air transportation of persons, property, and mail between Los Angeles, California, on the one hand, and Leon/Guanajuato, Mexico, and Los Mochis, Mexico, on the other hand. Northwest states that it seeks this new exemption authority to serve these markets pursuant to a code-share arrangement with ExpressJet, whereby Northwest will place its "NW" code on the flights of ExpressJet on the subject routes.


Consistent with our standard policy, the dormancy notice period will begin on the carrier's proposed startup date of August 3, 2008, in the following U.S.-Mexico city-pair markets: Los Angeles, California, on the one hand, and Acapulco (for code-share services with ExpressJet), Leon/Guanajuato, Culiacan, La Paz, Los Mochis, Loreto, Mazatlan, Torreon, Zacatecas, Ixtapa/Zihuatanejo, and Manzanillo, Mexico, on the other hand.

Application for Amended US-Mexico Exemption and Codeshare Authority

Hereby requests amendment or reinstatement of certain exemption authorities under 49 U.S.C. § 41101 and designations to enable Northwest to provide scheduled foreign air transportation of persons, property and mail on a codeshare basis between the United States and Mexico. Northwest has previously been authorized and designated to provide codeshare service on each of the subject routes. However, due to changes in the service patterns of Northwest's mainline codeshare partners and their respective regional affiliates, Northwest requests amended exemption authority and/or additional codeshare designations to reflect current operator(s). Northwest also requests reinstatement of certain previously authorized codeshare routes for which exemption authority has expired.

A surplus of codeshare‑only designations exists in each of the markets where Northwest is requesting amendment or reinstatement of exemptions. The relief requested by Northwest is in the public interest for the same reasons that supported the original issuance of codeshare exemption authority to Northwest for each of the subject routes.

ATLANTA-COZUMEL - Amend Northwest exemption authority with Delta Air Lines, Inc. to include operators Atlantic Southeast Airlines, Inc. and Pinnacle Airlines, Inc. (Docket OST-2006-23979).

ATLANTA-GUADALAJARA - Amend Northwest exemption authority with Delta to include operators ASA and Shuttle America Corporation. (Docket OST-2003-15507).

ATLANTA-MONTERREY - Amend Northwest exemption authority with ASA to include operator Shuttle America. (Docket OST-2003-15507).
