OST-2003-15507 - Exemption - US-Mexico Codeshare with Delta Air Lines June 24, 2003 Applies under 49 U.S.C. § 40109 and Rule 302 of the Department's Rules of Practice for an exemption from 49 U.S.C. § 41101 authorizing Northwest to provide scheduled foreign air transportation of persons, property and mail between Atlanta and Sao Paulo, Brazil; Bogota, Colombia; Cancun, Guadalajara, Mexico City, Monterrey and San Jose del Cabo, Mexico; and Lima, Peru; between Cincinnati and Cancun; and between Los Angeles and Guadalajara; and to combine the authority requested herein with Northwest's other certificate and exemption authority.' Northwest intends to use this authority to code-share with Delta Air Lines, Inc. and requests that the authority be issued on an expedited basis for a period of no less than two years. Northwest states that, with the exception of the Atlanta-Monterrey market, it requests renewal of this authority in order to continue to offer service under a code-share arrangement with Delta Air Lines, Inc. (Delta), whereby Northwest places its “NW*” code on flights operated by Delta in the captioned markets. October 3, 2006 Application for an Amended Exemption Northwest hereby applies for an amendment to its exemption in the above-captioned docket, so as to permit Northwest to codeshare on Delta and/or Delta Connection operated flights on the following routes, effective on the dates indicated:
Routes denoted by “*” are currently planned for operation by Atlantic Southeast Airlines; Northwest requests flexibility to use its exemption authorization for the services operated by Delta and/or Delta Connection carriers on the subject routes. Northwest also requests a codeshare-only designation for the listed routes to/from Mexico. Northwest requests that all of its U.S.-Mexico authorities be issued with the Department’s standard 90 day dormancy condition to run from the proposed start date of each service, specifically including Zihuatanejo, which will begin slightly more than 6 months from today’s date. For ease of administrative efficiency, Northwest requests that its amended exemption authority be granted coextensive with the October 4, 2007 expiration date of the other U.S.- Mexico codeshare exemption authorities in this docket. October 10, 2006 This letter is to confirm that Northwest Airlines, Inc. has polled all carriers included on the service list to the above referenced application and none intend to file an objection. Filed October 3, 2006 | Issued November 9, 2006 Amended exemption in this docket under 49 U.S.C. 40109 to: Add additional U.S.-Mexico transborder routes that will be served pursuant to a code-share arrangement, whereby Northwest will place its NW* code on (1) flights operated by Delta Air Lines, Inc., on the following routes: between Los Angeles, California, on the one hand, and Acapulco, Cancun, Guadalajara, Puerto Vallarta, and Zihuatanejo, Mexico, on the other hand; and (2) flights operated by Atlantic Southeast Airlines, as a Delta Connection carrier, between Atlanta, Georgia, and Leon, Mexico, and between Los Angeles, California, on the one hand, and Culiacan, Hermosillo, La Paz, Loreto, Manzanillo, Mazatlan, Torreon, and Zacatecas, Mexico, on the other hand. Northwest also requests authority to combine this exemption with all of Northwest's existing certificate and exemption authority, consistent with applicable international agreements. Northwest requests that its amended exemption authority be granted coextensive with the October 4, 2007, expiration date of the other U.S.-Mexico code-share exemption authorities in this docket. Northwest informally advised us that, while its application referred to Delta Connection Carriers (application at 1, footnote 1), in fact the only Delta Connection carrier it intends its application to encompass is ASA. Northwest also advised us informally that it recognizes that it can only code-share on routes where the direct carrier holds the necessary underlying economic authority. Northwest was previously issued exemption authority to operate codeshare services operated by ASA between Los Angeles and various points in Mexico. Northwest is not currently offering those codeshare services, and ASA has been replaced on these Los Angeles-Mexico routes by ExpressJet. Northwest therefore requests new or amended exemption authority' to enable Northwest to offer codeshare service on routes operated by ExpressJet between Los Angeles and the following points in Mexico:
Northwest expects to display its code on the subject ExpressJet flights within one year of the date of this application, and requests that Department's standard 90 day dormancy condition run from August 3, 2008. OST-2003-15507 - US-Mexico Codesharing with Delta January 18, 2008 Application for Amended US-Mexico Exemption and Codeshare Authority Hereby requests amendment or reinstatement of certain exemption authorities under 49 U.S.C. § 41101 and designations to enable Northwest to provide scheduled foreign air transportation of persons, property and mail on a codeshare basis between the United States and Mexico. Northwest has previously been authorized and designated to provide codeshare service on each of the subject routes. However, due to changes in the service patterns of Northwest's mainline codeshare partners and their respective regional affiliates, Northwest requests amended exemption authority and/or additional codeshare designations to reflect current operator(s). Northwest also requests reinstatement of certain previously authorized codeshare routes for which exemption authority has expired. A surplus of codeshare‑only designations exists in each of the markets where Northwest is requesting amendment or reinstatement of exemptions. The relief requested by Northwest is in the public interest for the same reasons that supported the original issuance of codeshare exemption authority to Northwest for each of the subject routes.

February 20, 2008 Application for an Exemption and Designation Northwest seeks exemption authority so it can provide scheduled foreign air transportation of persons, property and mail between Atlanta and Queretaro by codesharing on flights operated by Shuttle America d/b/a Delta Connection in this city-pair market, pursuant to a codeshare agreement with Delta. Delta/Shuttle America holds underlying authority to serve this city-pair market. Northwest requests that the exemption authority be issued as soon as possible for a period of two years.
