For its initial scheduled transborder operations, UYJ Air plans to provide foreign air transportation between Toronto and Savannah, Georgia, one day a week, in addition to its ongoing ad hoc charter flights between points in Canada and various points in the United States utilizing 9-passenger Learjet 45 aircraft, and 12-passenger Cessna Citation C750 aircraft UYJ Air's current aircraft fleet consists of two Learjet 45 aircraft and one Cessna Citation X Model C750 aircraft.

Exemption from 49 USC § 41301 to conduct scheduled and charter flights carrying persons, property, and mail between any point or points in Canada and any point or points in the United States, and other charter flights in accordance with 14 CFR Part 212, using small equipment.  The applicant requests that the authority be granted for a two-year term.

Uniform Yankee Juliet’s application was accompanied by a motion under Rule 12 (14 CFR § 302.12) to withhold certain financial information from public disclosure.  In support of its motion, Uniform Yankee Juliet states that the information is competitively sensitive and highly confidential, and that Uniform Yankee Juliet would be adversely affected by its disclosure.  We have reviewed the documents under the disclosure guidelines of Rule 12 and have determined that they warrant confidential treatment.  Because of the commercially sensitive nature of the information, we have determined that the documents fall within the Freedom of Information Act exemption for proprietary information and would adversely affect the competitive position of Uniform Yankee Juliet under 49 USC § 40115.

Uniform Yankee Juliet Air Inc. hereby applies for renewal of its temporary exemption from 49 U.S.C. 41301 authorizing UYJ Air to perform transborder scheduled and charter flights carrying persons, property and mail between any point or points in Canada and any point or points in the United States pursuant to the February 1995 Bilateral Air Transport Services Agreement between Canada and the United States. The current exemption authority issued to UYJ Air was most recently granted by Notice of Action Taken, issued on November 2, 2005.

UYJ Air requests that the foregoing authority be granted for a period of one year, through November 2, 2007, or until 90 days after final action by the Department on a forthcoming application by UYJ Air for a Foreign Air Carrier Permit pursuant to 49 U.S.C. 41302 authorizing the same broad-scope transborder operations.
