Application for Exemption Authority Pursuant to 49 USC 40109

China Eastern Airlines Corporation Limited hereby applies for exemption authority, to the extent the Department deems it necessary, to conduct scheduled foreign air transportation of persons, property and mail between the People's Republic of China and Los Angeles. The flights will operate as through flights via Shanghai (PVG) and Beijing (PEK).

China Eastern currently holds exemption authority to conduct flights between the People's Republic of China cities of Chongqing, see Notice of Action Taken on October 12, 2005, Docket OST-2005-22515; Dalian and Chengdu, see Notice of Action Taken on July 12, 2005, Docket OST-2005-21810; and Shenyang and Shenzhen, see Notice of Action Taken on March 9,2005, Docket OST-2005-20561, on the one hand, and Los Angeles, California on the other, via Shanghai. The through flights are operated in conjunction with China Eastern's daily scheduled service between Shanghai and Los Angeles.

China Eastern currently holds permit authority under DOT Order 92-11-7 to conduct operations between Beijing, Guangzhou, and Shanghai via Tokyo or another point in Japan to Chicago, Los Angeles, San Francisco and Honolulu or Seattle. China Eastern is fit, willing and able to perform the services for which the exemption is sought. China Eastern has been found fit for similar service by the Department, most recently on October 12, 2005 (OST-2005-22515).

China Eastern now proposes to provide service between Xian, Peoples Republic of China, and Los Angeles, via Shanghai beginning December 11, 2005. The requested authority is necessary in order to allow China Eastern to sell Xian-Los Angeles service, to allow the airline to freely sell single flight number service between the behind gateway points in China and Los Angeles; and to consolidate the above-listed exemption authorities into a single docket. So that it may begin advertising this service as soon as possible, China Eastern will poll the carriers on the service list to ensure that there are no objections and will notify the Department of its results.

By Notice of Action dated December 6,2005 in Docket OST-2005-23074, the Department additionally granted China Eastern an exemption from 49 U.S.C. § 41301 which is the subject of this renewal application, permitting it to carry persons, property and mail in scheduled service between a point or points in the People's Republic of China, and Los Angeles, with all flights operating via Shanghai and/or Beijing. The authority was subsequently renewed on February 7, 2008. This exemption is set to expire on February 7, 2009 and China Eastern seeks an extension for an additional period of one year.

China Eastern intends to use its renewed exemption authority to conduct its twice weekly flights between a point or points in the People's Republic of China, and Los Angeles, with all flights operating via Shanghai and/or Beijing.

Application for Renewal of Exemption Authority

In the past, the applicant would apply for renewal four separate times a year, and the Department would have to process the applications four times a year. In the interests of efficiency, and to save applicant's and the Department's administrative recourses, China Eastern hereby requests grant of all four exemptions at once so that all future renewals will fall on the same date. Thereby, for all future renewals, China Eastern will only need to file one renewal application each year covering the four exemptions and the Department will only have to process one Order a year instead of four.

China Eastern requests renewal of its existing exemption authority on the following routes that were granted in the following dockets:

  1. between Beijing, People's Republic of China and Saipan, Commonwealth of the Northern Mariana Islands; last granted on November 1, 2012 in Docket OST-2012-0185. China Eastern's exemption authority would expire on November 1, 2013 absent this timely renewal application.
  2. between Shanghai, People's Republic of China and Saipan, Commonwealth of the Northern Mariana Islands; last granted April 10, 2013 in Docket OST-2004-17665. China Eastern's exemption authority would expire on April 10, 2014 absent this timely renewal application.
  3. between any point or points in the People's Republic of China and San Francisco, California, with all flights operating via Shanghai; last granted on April 19, 2013, in Docket OST-2013-0079. China Eastern's exemption authority would expire on April 19, 2014 absent this timely renewal application; and
  4. between any point or points in the People's Republic of China and Los Angeles, with all flights operating via Shanghai and/or Beijing; last granted on June 12, 2013 in Docket OST-2005-23074. China Eastern's exemption authority would expire on June 12, 2014 absent this timely renewal application.

China Eastern Airlines Corporation Limited asks that the Department renew its exemption authorizing it to conduct scheduled foreign air transportation of persons, property and mail (i) between Beijing, People's Republic of China and Saipan, Commonwealth of the Northern Mariana Islands; (ii) between Shanghai, People's Republic of China and Saipan, Commonwealth of the Northern Mariana Islands; (iii) between any point or points in the People's Republic of China and San Francisco, California, with all flights operating via Shanghai; and (iv) between any point or points in the People's Republic of China and Los Angeles, California with all flights operating via Shanghai and/or Beijing.

Application for Renewal and Reissuance of Exemption Authority

Requests renewal and reissuance, in a single docket, of the many exemptions authorizing it to conduct scheduled foreign air transportation of persons, property and mail in the markets between China and the United States as described below. Renewing these authorities individually is a heavy administrative burden for both China Eastern and the Department. Accordingly, China Eastern requests that all of the below-referenced exemption authorities be renewed and reissued in a single docket and awarded for the same period of time with the same expiration date.
