Application for a Foreign Air Carrier Permit and an Exemption - Bookmarked - 11MB

VIM Airlines is requesting a foreign air carrier permit authorizing it to engage in charter transportation of passengers, property and mail (1) between any point or points in the Russian Federation and any point or points in the United States; and (2) between any point or points in the United States and any point or points in a third country or countries.

VIM Airlines will utilize Boeing 757-200 aircraft for its proposed U.S. operations, or such other aircraft as it may have or acquire to conduct the proposed operations.

VIM Airlines is a limited liability company founded as such and registered as a legal entity on October 15, 2002, under the applicable laws of the Russian Federation. VIM Airlines is privately owned and effectively controlled by Russian nationals.

Motion for Confidential Treatment

VIM Airlines hereby files this Motion to withhold from public disclosure certain confidential information contained in financial data summaries, six pages, which are submitted as Exhibit VIM-13, in support of the above-referenced application, filed April 28, 2008.

VIM is a well-known passenger and combination operator in Russia, with a significant network of domestic and international routes and a vast range of charter services. Moreover, the Government of Russia has designated it to perform the requested foreign air transportation services between the U.S. and Russia, as is required by 49 U.S.C. § 41302(2)(A). Where, as is the case here, the financial fitness of a carrier is not in question, the disclosure of confidential financial information does not further the public interest.

Issued and Served July 29, 2008

Order Granting Exemption and to Show Cause

We exempt VIM Airlines from the provisions of 49 U.S.C. §41301 to the extent necessary to permit it to engage in charter foreign air transportation of persons, property, and mail between any point or points in the Russian Federation and any point or points in the United States, and other charters in accordance with 14 CFR Part 212.

We grant the request of VIM Airlines for confidential treatment of its financial submissions, consistent with the provisions of 14 CFR §302.12.

With respect to the applicant’s request for a foreign air carrier permit in this proceeding, we direct all interested persons to show cause why our tentative decision on that application, set forth above, should not be made final. Any interested person objecting to the issuance of an order making final our tentative findings and conclusions with respect to the applicant’s request for a foreign air carrier permit shall, no later than twenty-one calendar days after the date of service of this order, file with the Department.
