Application for Exemption Authority

Motion to Shorten Answer Period

Air Pacific requests authority to operate roundtrip service once weekly on the following route: Nadi, Fiji-Apia, Samoa-Honolulu, Hawaii. The service will be operated primarily with Air Pacific's B737-700 and B737-800 aircraft. There will be local round-trip traffic between Apia, Samoa and Honolulu, Hawaii as well as between Apia, Samoa and Nadi, Fiji. Air Pacific intends to begin operating this route beginning in September 2009 and would like to begin advertising and selling the service immediately.

Air Pacific has been granted exemption authority to conduct scheduled air transportation between Nadi, Fiji and Honolulu, Hawaii via Christmas Islands, Kiribati. See Notice of Action Taken in Docket OST-2005-21868, dated June 10, 2009. Additionally, Air Pacific has been granted exemption authority to conduct scheduled air transportation between Nadi, Fiji, and the two U.S. coterminal points of Los Angeles, California and Honolulu, Hawaii, via Auckland, New Zealand, and beyond the two U.S. coterminal points to, and from, the two Canadian coterminal points Toronto and Vancouver. Application for Renewal of Exemption Authority

The service will continue to be operated primarily with Air Pacific's B737-700 and B737-800 aircraft. There will be local round-trip traffic between Apia, Samoa and Honolulu, Hawaii as well as between Apia, Samoa and Nadi, Fiji. Air Pacific's exemption authority would expire on July 9, 2010 absent this renewal application and Air Pacific seeks an extension for an additional period of one year.

Air Pacific holds a foreign air carrier operating permit to "engage in foreign air transportation of persons, property, and mail[.]" See Order 81-4-94 in Docket #36485, dated February 18, 1981. Air Pacific has also been granted exemption authority to conduct scheduled air transportation between Nadi, Fiji and Honolulu, Hawaii via Christmas Islands, Kiribati. See Notice of Action Taken in Docket OST-2005-21868, dated June 17,2010. Additionally, Air Pacific has been granted exemption authority to conduct scheduled air transportation between Nadi, Fiji, and the two U.S. coterminal points of Los Angeles, California and Honolulu, Hawaii, via Auckland, New Zealand, and beyond the two U.S. coterminal points to, and from, the two Canadian coterminal points Toronto and Vancouver. Air Pacific hereby applies for a renewal of exemption from 49 USC § 41301 and other such applicable statutory provisions and regulations of the Department as may be necessary to continue to engage in scheduled air transportation of persons, property and mail between Nadi, Fiji and Honolulu, Hawaii via Apia, Samoa.

The service will continue to be operated primarily with Air Pacific's B737-700 and B737-800 aircraft. There will be local round-trip traffic between Apia, Samoa and Honolulu, Hawaii as well as between Apia, Samoa and Nadi, Fiji. Air Pacific's exemption authority would expire on July 9, 2010 absent this renewal application and Air Pacific seeks an extension for an additional period of one year.

This renewal application was not filed earlier due to uncertainty about the Department’s operating status during the partial shutdown of the federal government.
