Some of the examptes accompanying the FedEx petition exceeded 8 hours of flight time in a 24-hour period. Since,the existing requirement is unambiguous, as are the reoccurring FAA interpretations over the intervening years, waiver should only be authorized where a compelling reason for change is established. FedEx cited only economic convenience as their reason for waiver. FAA interpretations upheld the existing rest requirement consistently for over 25 years (George L, Thompson letter to John R. Griffith dated 2-5-75; Edward P. Faberman to G.L. Davison dated 7-17-79; Edward P. Faberman to Richard Dutton dated 5-7-81; John H. Cassady to Robert D. Gray dated 3-11-88; Donald P. Byrne foRobert D. Gray dated 7-17-89; Donald P. Pyrne to Autumn Newsome dated 11-9-90; Donald P. Byrne to Arthur J.' Schniidt dated 4-9=921; Donald P. Byrne to John H. Dewitt dated 12-2-91; and Donald P. Byrne to Tom Kehmeir dated 1-21-00). It also was requested that system delays be added to reasons for delays in addition to weather, ATC, and maintenance delays. Such waiver is not in keeping with long standing interpretations and this organization opposes any such waiver.
