Motion for Confidential Treatment

Air Century, S.A. hereby applies for an exemption and a foreign air carrier permit authorizing ACSA to engage in charter foreign air transportation of persons, property, and mail between any point or points in the Dominican Republic and any point or points in the United States, and between any point or points in the United States and any point or points in a third country or countries provided that such traffic is carried via the Dominican Republic and makes a stopover in the Dominican Republic for at least two consecutive nights; and other charters pursuant to the prior approval requirements set forth in the Department's regulations.

As soon as its initial exemption authority has been granted, ACSA plans to make its on-demand service available to passengers and shippers seeking service to and from points in the United States, using any of the jet and turboprop aircraft in its fleet. ACSA has been providing service of comparable character and scope for years, both within the Dominican Republic and throughout the Caribbean, and it is fully prepared to expand its service offerings to points in Puerto Rico and the U.S. Virgin Islands, as well as the mainland United States, as dictated by the requirements of its charter customers.

Order Granting Exemption and to Show Cause

We grant the request of Air Century, S.A. for an exemption under 49 U.S.C. §40109 to permit it to engage in: (1) charter foreign air transportation of persons, property, and mail between any point or points in the Dominican Republic and any point or points in the United States, and between any point or points in the United States and any point or points in a third country or countries, provided that such traffic is carried via the Dominican Republic and makes a stopover in the Dominican Republic for at least two consecutive nights; and (2) other charter operations pursuant to 14 CFR Part 212.

With respect to the applicant’s request for a foreign air carrier permit in this proceeding, we direct all interested persons to show cause why our tentative decision on that application, set forth above, should not be made final. Any interested person objecting to the issuance of an order making final our tentative findings and conclusions with respect to the applicant’s request for a foreign air carrier permit shall, no later than twenty-one calendar days after the date of service of this order, file with the Department

Final Order

By Order 2008-1-7, issued January 14, 2008, we directed all interested persons to show cause why we should not make final our tentative findings and conclusions stated therein and award a foreign air carrier permit in the form attached to the Order and subject to the conditions attached thereto. We gave interested persons 21 days to file objections to the Order. We said that if no objections are filed, all further procedural steps shall be deemed waived, and the Department will enter an order (subject to Presidential review under 49 USC §41307) which will make final the findings and conclusions of the Order.

No objections were received within the time period provided.

Application for an Exemption and an Amended Foreign Air Carrier Permit

Motion for Confidential Treatment

On or about August 15, 2016, Air Century intends to introduce (1) scheduled flights carrying passengers and cargo between Santo Domingo, Dominican Republic and San Juan, Puerto Rico using Saab 340B aircraft; and (2) scheduled all-cargo flights between Santo Domingo, Dominican Republic and Miami, Florida using ATR 72 freighter aircraft. In light of the proposed start date for these services, Air Century requests immediate consideration of this application and will be polling the US air carriers served with this application to help facilitate prompt DOT approval.

Because its proposed new all-cargo services will be conducted using a large aircraft, Air Century further requests an exemption from the provision in its Foreign Air Carrier Permit that limits its operations to aircraft capable of carrying no more than 60 passengers and having a maximum payload capacity of no more than 18,000 pounds and requests removal of this restriction from its amended Permit.

On or about August 15, 2016, or as soon as possible after its initial exemption authority has been granted and all other regulatory requirements and commercial arrangements have been addressed, Air Century intends to offer scheduled combination (passenger and cargo) service between Santo Domingo and San Juan and scheduled all-cargo service between Santo Domingo and Miami. The Applicant also desires the flexibility to introduce additional services to and from Miami and points in Puerto Rico within the scope of the authority to be issued by DOT, as dictated by evolving market opportunities.

Air Century, S.A. hereby (a) applies for renewal of its Dominican Republic-San Juan exemption authority approved by Notice of Action Taken dated August 19, 2016, and (b) supplements its pending application for an exemption and an amended foreign air carrier permit for authority to engage in scheduled foreign air transportation of persons, property and mail between a point or points in the Dominican Republic, on the one hand, and Miami, Florida and a point or points in Puerto Rico, on the other hand, in Docket OST-2007-0019.

Air Century requests that the Department issue a single Order (a) renewing its Dominican Republic-San Juan exemption authority for an additional year, (b) approving its Dominican Republic-Miami exemption authority for a period of one year, (c) approving an exemption from the foreign air carrier permit condition that limits its operations to aircraft capable of carrying no more than 60 passengers and having a maximum payload capacity of no more than 18,000 pounds, and (d) tentatively awarding an amended foreign air carrier permit to include the scheduled Dominican Republic- Miami/Puerto Rico authority described in its Application of April 29, 2016. As soon as possible thereafter, Air Century requests that the Department issue a Final Order issuing Air Century its amended foreign air carrier permit for a period of indefinite duration.

Air Century hereby applies for renewal of its exemption authority approved by Notice of Action Taken dated October 23, 2017, to continue to permit Air Century to engage in (a) scheduled foreign air transportation of persons, property, and mail between a point or points in the Dominican Republic and San Juan, Puerto Rico; (b) scheduled foreign air transportation of persons, property, and mail between a point or points in the Dominican Republic and Miami, Florida; c) charter foreign air transportation of persons, property and mail between any point or points in the Dominican Republic and any point or points in the United States, and between any point or points in the United States and any point or points in a third country or countries, provided that such traffic is carried via the Dominican Republic and makes a stopover in the Dominican Republic for at least two consecutive nights; and d) other charters pursuant to 14 CFR Part 212. The current exemption authority expires on October 23, 2018. Air Century requests renewal for at least one year or until its pending application under the Department’s Streamlined Licensing Procedures for comparable foreign air carrier permit authority in Docket OST-2007-0019 comes into effect, whichever occurs first.
