Notice approving renewal exemption for two years under 49 U.S.C. 40109 to provide the following service: Scheduled foreign air transportation of property and mail between Guam, on the one hand and Manila and Hong Kong, on the other hand; and the authority to integrate this exemption with Air Micronesia's other exemption and certificate authority. The authority granted was effective when taken: June 5, 2003, through June 5, 2005. Petitions are due: June 16, 2003. The authority granted is consistent with the aviation agreement between the United States and the Philippines, and the October 19, 2002, Memorandum of Understanding between the United States and Hong Kong.

By Order 96-8-35 in the Hong Kong Fifth-Freedom All-Cargo Proceeding Docket OST-95-764, the Department granted Air Micronesia exemption authority to provide Guam-Manila-Hong Kong cargo service, and its authority was most recently renewed by Notice of Action Taken dated June 5, 2003 issued in this docket. If not renewed, Air Micronesia's Guam-Manila-Hong Kong exemption authority will expire on June 5, 2005.

Although Air Micronesia is not currently providing Guam‑Manila‑Hong Kong all‑cargo service, Air Micronesia seeks renewal of its exemption so it may institute Third and Fourth Freedom Hong Kong service when conditions warrant.

Air Micronesia does not currently hold any frequency allocation to provide Fifth Freedom flights serving Hong Kong, and it is not seeking any such frequencies at this time.

Air Micronesia applies to renew its exemption to provide scheduled all-cargo service between Guam, on the one hand, and Manila and Hong Kong, on the other hand, and its authority to integrate this exemption with its other exemption and certificate authority for a period of no less than two years.

Air Micronesia does not currently hold any frequency allocation to provide Fifth Freedom flights serving Hong Kong, and it is not seeking any such frequencies at this time.

Order Cancelling Certificate Authority

The air carriers identified below were previously found fit and issued effective certificate authority by the Department. According to our records, these air carriers subsequently ceased operations and requested cancellation of their certificate authority. Under these circumstances, we will terminate the air carriers’ authority.

Songbird Airways - By Order 2015-6-5, issued June 5, 2015, we reissued to Songbird Airways, Inc. certificates of public convenience and necessity authorizing the air carrier to engage in interstate and foreign charter air transportation of persons, property, and mail. The air carrier operated under its authority until February 7, 2017, when it ceased all operations. On December 4, 2017, Songbird’s representative informed the Department that the air carrier would not seek to resume operations. Under these circumstances, and in accordance with section 204.7 of our rules, we cancel Songbird’s certificate authority.

Business Jet Services - By Order 2007-10-26, issued October 22, 2007, and Order 2009-3-24, issued March 31, 2009, we reissued to Business Jet Services, Ltd. certificates of public convenience and necessity authorizing the air carrier to engage in interstate and foreign charter air transportation of persons, property, and mail. The air carrier operated under its authority until December 2013, when it ceased its large aircraft operations and registered under 14 CFR Part 298 as an air taxi operator. By letter dated December 18, 2013, BJS’s representative notified the Department that the air carrier no longer intends to conduct operations as a certificated air carrier. To date, we have not received an application from BJS to have its fitness re-determined. Under these circumstances, and in accordance with section 204.7 of our rules, we cancel BJS’s certificate authority.

Priester Aviation - By Order 2009-1-6, issued January 14, 2009, we reissued to Priester Aviation, LLC certificates of public convenience and necessity authorizing the air carrier to engage in interstate and foreign charter air transportation of persons, property, and mail. By letter dated March 29, 2017, Priester’s representative notified the Department that the air carrier no longer intends to conduct operations as a certificated air carrier and surrendered its certificates for cancellation. Under these circumstances, and in accordance with section 204.7 of our rules, we cancel Priester’s certificate authority.

Air Micronesia and Continental Micronesia - Air Micronesia, Inc. and Continental Micronesia, Inc. hold various certificate, exemption, and other authority from the Department. In order to facilitate the merger of Continental Airlines, Inc., United Airlines, Inc., AMI, and CMI, the Department amended the certificate and other economic authorities of AMI and CMI to be jointly held by AMI, CMI, Continental, and United. AMI and CMI have both since ceased operations. On February 5, 2018, AMI’s and CMI’s representative informed the Department that neither company objected to the cancellation of the economic authorities independently held by each of AMI and CMI since the same economic authorities have also been transferred to United. Under these circumstances, and in accordance with section 204.7 of our rules, we cancel the interstate and blanket open skies authorities of AMI and CMI.
