Application for an Exemption and a Statement of Authorization

Airwork proposes to wet lease Boeing 737‑300 aircraft for the scheduled operations of Palau Micronesia Air, including operations between Palau, the Federated States of Micronesia, and Guam and Saipan. Palau Micronesia Air, which has applied for its own exemption authority in Docket OST‑2004‑17618, initially proposes to operate twice‑weekly service to the U.S. over the following routings: Koror (Palau)‑Guam and Koror‑Yap (FSM)‑Guam‑Chuuk (FSM)‑Polmpei (FSM).

Airwork is the second largest aviation enterprise in New Zealand. It has operated since 1936 and today conducts both aviation support and air transportation services in New Zealand and the South Pacific. It is 55.5% owned by its Managing Director, Hugh Jones, and its directors and key personnel all are New Zealand citizens. While the remaining ownership is Canadian, this ownership and management structure complies with article 3(2) of the groundbreaking 2001 Multilateral Agreement on the Liberalization of International Air Transportation to which the United States and New Zealand are parties.

Supplement No. 1 to Application for an Exemption

On July 20, 2004, the Civil Aviation Authority of New Zealand issued amended Operations Specifications to Airwork Holdings Limited. Those Operations Specifications authorize Airwork to serve Guam and the points in Palau and the Federated States of Micronesia identified in paragraph 2 of Airwork's May 17, 2004 application as the initial service points for its wet-lease operation on behalf of Palau Micronesia Air, an applicant for exemption authority in Docket OST-2004-17618. A copy of the amended Operations Specifications is attached. The carrier's family assistance plan, passenger manifest plan, and Montreal Agreement are on file with the Department, and a certificate of insurance has been filed with the Federal Aviation Administration

Notice of Action Taken

Exemption from 49 USC section 41301 to permit the applicant to engage in charter foreign air transportation of persons, property and mail between New Zealand and the United States and other charter operations under 14 CFR Part 212.

Statement of Authorization under 14 CFR Part 212 to permit the applicant to wet-lease Boeing 737 equipment, to Palau Rock Island Air, Inc., for the operation of the Palauan carrier’s scheduled combination services, as follows: between the Republic of Palau, on the one hand, via intermediate points in the Federated States of Micronesia, to and/or from Guam and the Commonwealth of the Northern Mariana Islands, on the other hand, and beyond to points in the Federated States of Micronesia.
