Order Granting Exemption and To Show Cause

By applications filed July 5, 2006, ANA & JP Express Co., Ltd., a foreign air carrier of Japan, requests an initial exemption under 49 U.S.C. §40109, and a foreign air carrier permit under 49 U.S.C. §41301, to engage in: 1) scheduled foreign air transportation of property and mail between any point or points in Japan and Chicago, Illinois, via a technical stop at Anchorage, Alaska; 2) charter foreign air transportation of property and mail between any point or points in Japan and any point or points in the United States; and 3) other charter operations in accordance with 14 C.F.R. Part 212. The applicant requests that the exemption authority it seeks he granted for a term of two years.

By Order 2006-9-11, issued September 13, 2006, we directed all interested persons to show cause why we should not make final our tentative findings and conclusions stated therein and award a foreign air carrier permit in the form attached to the Order and subject to the conditions attached thereto.  We gave interested persons 21 days to file objections to the Order.  We said that if no objections are filed, all further procedural steps shall be deemed waived, and the Department will enter an order which will make final the findings and conclusions of the Order.

No objections were received within the time period provided.

We make final our findings and conclusions as stated in Order 2006-9-11 and award to ANA & JP Express Co., Ltd. the foreign air carrier permit.

OST-2009-0229 - Statement of Authorization - US-South Korea Codesharing with UPS

Application for Statement of Authorization and Waiver - Bookmarked

ANA & IP Express Co., Ltd., a subsidiary of All Nippon Airways Co., Ltd. has entered into a Codeshare Agreement with United Parcel Service Co. under which, inter alia, AN will display UPS' 5X* designator code on certain AJV flights. Accordingly, AJV requests that the Department grant it (1) a statement of authorization pursuant to 14 CFR Part 212 to enable AJV to display the designator code of UPS on the AJV flights specified herein, and (2) a waiver of the 45-day advance filing requirement.

On March 12, 2009, the Department granted ANA and UPS a statement of authorization in docket OST-2009-0061. Pursuant to the Codeshare Agreement between ANA and UPS and this authorization, ANA displays UPS' 5X* code on ANA all-cargo flights between (1) Tokyo (NRT) and Chicago (via Anchorage); (2) Tokyo (NRT) and Taipei; and (3) Tokyo (NRT) and Seoul using Boeing 767-300F aircraft wet-leased from AJV.

ANA has decided that AJV will operate the Tokyo (NRT)-Seoul flights under its own (9N) traffic rights. Beginning October 25, 2009, AJV will display UPS' 5X code on NV all-cargo flights in this market, for the purposes of transporting UPS cargo and mail between the US and South Korea, in both directions. Service between NRT and ICN will be conducted on a blind sector basis.

Department Action on Application

Application of ANA & JP Express Co., Ltd. for a Statement of Anthorization to permit AJV to display the "5X" designator code of United Parcel Service Co. on flights operated by AJV between Tokyo, Japan and Seonl, Korea, for the purposes of transporting UPS cargo and mail between the United States and South Korea, in both directions. AJV also requests a waiver of the 45-day advance filing requirement under 14 CFR Part 212.

The applicant notes that service between Tokyo and Seoul will be conducted on a blind sector basis.

The Department is acting on AJV's application prior to the expiration of the 45-day advance filing requirement with the consent of all parties served.
