Notice of Action Taken

Exemption from 49 USC § 41301 to engage in scheduled foreign air transportation of persons, property and mail by displaying the code of any duly authorized US air carrier on flights it operates on behalf of Deutsche Lufthansa AG between any point or points in any Member State of the European Union and beyond the European Union to any point or points.

This exemption provides the holder with underlying authority to conduct the described codeshare operations. The holder must also hold an appropriate Statement of Authorization under 14 CFR Part 212 before conducting any code-share operations authorized by this notice.

Application for Renewal of an Exemption

Cirrus Airlines hereby applies for renewal of an exemption from 49 USC § 41301 to authorize Cirrus to continue to display the airline designator code of any duly authorized US air carrier on scheduled flights operated by Cirrus, on behalf of Deutsche Lufthansa AG, between any point or points in any Member State of the European Union and beyond the European Union to any point or points.

Cirrus transports duly authorized US air carriers' US origin/destination passengers between any point or points in any Member State of the European Union and beyond the European Union to any point or points. Cirrus does not sell seats in its own name for travel to or from the United States and does not operate aircraft to any US Point.

OST-2011-0207 - Statements of Authorization - EU-US Codesharing with US Airways

Application for Statement of Authorization

Cirrus hereby requests a blanket statement of authorization pursuant to 14 C.F.R. Part 212 to display the "US" designator code of US Airways, Inc. on Cirrus's flights between any point or points in any Member State of the European Union and beyond the European Union to any point or points. US Airways is a code share partner of Deutsche Lufthansa AG. Cirrus operates flights within Europe on behalf of Lufthansa under the "Lufthansa Regional" name. Cirrus plans to initially di splay US Airways' designator code on its flights between Munich and both Berne and Erfurt (ERF); between Dresden and Hamburg (HAM); and between Frankfurt and Hof (HOQ). Cirrus and US Airways plan to initiate the proposed code-share services as soon as all governmental approvals are obtained.

Cirrus operates flights within Europe on behalf of Lufthansa under the "Lufthansa Regional" name pursuant to a marketing and franchise agreement. Lufthansa and US Airways hold authority from the Department to engage in code sharing on a reciprocal basis pursuant to an alliance agreement between these carriers (See Joint Application of US Airways, Inc. and Deutsche Lufthansa AG for Statements of Authorization and Exemption, August 13, 2003, Exhibit 1, Docket OST-2003-15946).

On behalf of Cirrus Airlines Luftahrtgesellschaft Mbh, I have polled the representatives of all US carriers listed on the certificate of service attached to the Application of Cirrus Airlines Luftahrtgesellschaft Mbh for Statement of Authorization filed on November 14, 2011 in the above-referenced docket. None of the US carrier representatives had any objection to the application.

On behalf of Cirrus Airlines Luftfahrtgesellschaft GbH & Co., please be advised that due to the filing for bankruptcy relief, and subsequent termination of its air operators certificate by the German authorities, we hereby withdraw the Application for Statement of Authorization filed in Docket No. OST-2011-0207 on November 14, 2011.
