Notice of Approval

United Air Lines, American Airlines, and US Airways filed in opposition to the application. The opposing parties based their opposition solely on Italian Government policies affecting U.S. carriers code‑share access to Milan's Linate Airport. Alitalia and Alitalia Express filed a reply. United filed a response.

On November 24, 2004, American Airlines and United Air Lines filed a Joint Complaint under Section 2(b) of the International Air Transportation Fair Competitive Practices Act, as amended, against Alitalia and the Government of Italy on the Linate access issue. See Docket OST-2004-19790. On July 25, 2005, the Department issued an order dismissing the Joint Complaint. Order 2005-7-22. Against this background, we are granting the Statement of Authorization.

Re: 30-Day Codeshare Notice

Continental and Alitalia intend to begin codeshare service on the following additional route segment, on or after thirty days from today:

Milan‑Budapest

Continental holds authority to provide foreign air transportation between points in the United States and Budapest (see Notice of Action Taken, Docket OST-98-4929, November 21, 2006) and between the United States and points in Italy and beyond to points in third countries (see Continental's certificate for Route 792), and Continental understands that Milan has already been designated as a U.S. intermediate point for U.S. -Hungary service. Although Continental indicated when it renewed its Budapest authority that it did not then currently plan to initiate its own U.S.-Hungary services, it is now planning to institute U.S.-Hungary codeshare service with Alitalia.

Re: Cessation of Codesharing

By Notice of Action Taken dated July 27, 2005, the Department granted the applications of Continental, Continental Micronesia, Alitalia and Alitalia Express for codeshare authority. Continental notifies the Department, pursuant to condition (b) of that Notice of Action Taken, that Continental and Alitalia will cease codeshare service on the following route segments due to Alitalia's schedule changes at Milan as of March 30, 2008:

Joint Application for Blanket Statements of Authorization and Waiver

Continental Airlines, Inc., Continental Micronesia, Inc., C.A.l. Compagnia Aerea Italiana S.p.A. and its wholly-owned subsidiary C.A.l. First S.p.A. hereby jointly apply for (1) reissuance of the blanket statements of authorization in this docket to enable them to continue in effect the codesharing services described below following the purchase of assets of Alitalia-Linee Aeree Italiane S.p.A. by CAl Alitalia, which will do business as "Alitalia," and assets of Alitalia Express S.p.A. by CAl First, which will do business as "Alitalia Express," and (2) waiver of the Department's 45 day advance-notice requirement.

In light of Alitalia's impending cessation of operations on January 12, 2009, CAl Alitalia and Continental have entered into a new codesharing agreement. An executed copy of the agreement is being provided to the Department by separate cover. As CAl Alitalia will begin operations as "Alitalia" on or about January 13, 2009, the Joint Applicants respectfully request waiver of the Department's 45-day advance filing requirement. Such waiver is in the public interest, as the Joint Applicants already offer codesharing services, and CAl Alitalia and CAl First will simply replace Alitalia and Alitalia Express in the provision of these services. The Joint Applicants further request that all of the additional codesharing services previously noticed in this docket remain effective for codesharing services provided following CAl Alitalia's and CAl First's commencement of operations.

Alitalia's AZ* code will be displayed on flights operated by ExpressJet Airlines, Inc. and potentially other Continental codeshare partners operating aircraft with fewer than 60 seats. Pursuant to sections 206.5, 212.1 and 298.11 of the Department's regulations, no statement of authorization is required for such services. In addition, Continental's CO* code may be displayed on CAl AZ services within and beyond Italy operated under wet lease arrangements between CAl AZ with CAl First, Air One S.p.A. or Volare S.p.A. In such cases, CAl AZ and the wet lease operator will obtain whatever further authorization may be necessary from the Department in order for the CO* code to be displayed.
