Motion for Confidential Treatment

1263343 Alberta Inc d/b/a enerjet, a Canadian charter operator, hereby applies for an exemption and a foreign air carrier permit to engage in non-scheduled charter trips in foreign air transportation between Canada and the United States. Enerjet is a start-up company.

Enerjet's initial charter services may be to the following US States: Nevada, Texas, Florida, California, and Arizona. Other destinations may be added as enerjet discovers a business opportunity to fly there. The frequency of services at the start of operations, and any seasonal variations, will depend on the demand to fly into the United States. All of enerjet' s flights will be chartered flights for passengers and the aircraft type used is the Boeing 737-700 next generation aircraft. Enerjet's charters will operate as nonstop flights; therefore, a service schedule has not been determined. Enerjet will initially service non-stop charter flights between points in Canada and the United States. Enerjet intends to commence these services as soon as possible.

Supplement to Motion for Confidential Treatment

Pursuant to a request from the U.S. Department of Transportation for additional information, enerjet seeks to supplement Exhibit 4 (Ownership Structure) to its Application in this Docket. enerjet moves for confidential treatment of such supplemental information pursuant to Rule 12.

With regard to the confidentiality of Exhibit 4 (Ownership Structure), under Canadian law, enerjet is not required to publicly disclose the identity of its private investors, and enerjet therefore would not customarily release this information.

Re: Clarification of Application

On January 16, 2009, 1263343 Alberta Inc. d/b/a enerjet submitted an application in the above-referenced docket for a Foreign Air Carrier Permit and Exemption Authority. On March 11, 2009, the authority sought by enerjet pursuant to such application was clarified by the filing of a supplement to the application. enerjet hereby seeks to further clarify the authority sought under its application.

enerjet requests that the authority to be granted under its application provide for: (1) charter foreign air transportation of persons, property, and mail between any point or points in Canada and any point or points in the United States and any point or points in a third country or countries, provided that, except with respect to cargo charters, such service constitutes part of a continuous operation, with or without a change of aircraft, that includes service to Canada for the purpose of carrying local traffic between Canada and the United States; and (2) other charters in accordance with 14 CFR Part 212.

Order Granting Exemption and to Show Cause

We grant the request of 1263343 Alberta Inc. d/b/a Enerjet for an exemption under 49 U.S.C. § 40109 to engage in (1) charter foreign air transportation of persons, property and mail between any point or points in Canada and any point or points in the United States, and between any point or points in the United States and any point or points in a third country or countries, provided that, except with respect to cargo charters, such service constitutes part of a continuous operation, with or without a change of aircraft, that includes service to Canada for the purpose of carrying local traffic between Canada and the United States; and (2) other charters in accordance with 14 CFR Part 212 of the Department’s regulations.

With respect to the applicant’s request for a foreign air carrier permit in this proceeding, we direct all interested persons to show cause why our tentative decision on that application, set forth above, should not be made final. Any interested person objecting to the issuance of an order making final our tentative findings and conclusions with respect to the applicant’s request for a foreign air carrier permit shall, no later than twenty-one calendar days after the date of service of this order, file with the Department.

Final Order

By Order 2009-3-22, issued March 30, 2009, we directed all interested persons to show cause why we should not make final our tentative findings and conclusions stated therein and award a foreign air carrier permit in the form attached to the Order and subject to the conditions attached thereto. We gave interested persons 21 days to file objections to the Order. We said that if no objections are filed, all further procedural steps shall be deemed waived, and the Department will enter an order (subject to Presidential review under 49 USC §41307) which will make final the findings and conclusions of the Order.

No objections were received within the time period provided.

Application for an Amended Foreign Air Carrier Permit and Exemption Authority

Motion for Confidential Treatment

enerjet, a Canadian air carrier, hereby requests that the Department amend enerjet’s foreign air carrier permit to enable it to engage in scheduled air transportation of persons, property and mail between Canada and the United States.

enerjet currently performs non-scheduled chartered flights between Canada and the United States pursuant to its existing authority granted by the US Department of Transportation. enerjet received authority from the relevant Canadian aviation authorities to perform scheduled flights and desires to perform scheduled flights from Canada into the United States. Therefore, enerjet is requesting that the DOT expand enerjet’s authority to include performing scheduled air service between points in Canada and points in the United States. enerjet intends to commence its scheduled service into the United States as soon as possible.
