Application and Request for pendente lite Exemption

Concurrently with this application, Gama is filing for a certificate of public convenience and necessity authorizing it to engage in interstate charter air transportation of persons, property and mail with a BBJ aircraft. Gama respectfully requests that such application be incorporated herein by reference.

Gama is requesting that the Department exercise its discretionary authority to issue Gama an exemption pendente lite pending Department action on the instant certificate application. In the alternative, Gama requests that such authority be granted in time to enable Gama to commence such charter operations on or before January 1, 2013.

Application for Certificate of Public Convenience and Necessity

Gama Charters Inc. hereby applies for a certificate of public convenience and necessity authorizing Gama to engage in the interstate charter air transportation of persons, property and mail with a Boeing Business Jet aircraft. Gama requests that this application be processed under the non-hearing procedures prescribed by Subpart B of the Department's Rules of Practice, and asks that the Department issue the requested certificate authority as expeditiously as possible.

Gama is seeking authority to engage in on-demand, single entity charter services using a BBJ aircraft. To facilitate its proposed services, and in keeping with the arrangements employed for Gama' s current Part 13 5 operations, Gama will enter into a lease agreement with a BBJ owner that becomes effective only upon the issuance by the Department of a final and effective order granting Gama a certificate of public convenience and necessity.

Gama currently leases 35 aircraft for its Part 135 on-demand operations. These aircraft include a wide range of privately-owned corporate jets.

Motion for Confidential Treatment

After reviewing Gama's application, DOT calculated that Gama would need access to approximately $1.69 million in order to meet the Department's financial fitness criteria. This conclusion was based on the Department's analysis of Gama's pre-operating and first-year operating expenses, plus Gama's negative working capital balance of $242,416. The Department's analysis needs to be revised to account for much lower operating expenses and a significant improvement in Gama's year-end balance sheet.

Notice of Withdrawal of Application

Gama's application and the success of its business plan for BBJ operations were premised on the
availability of a single BBJ to be leased from Delaware Global Operation. The Delaware Global BBJ was recently sold and has come under the control of a new owner which does not plan to lease the aircraft to Gama. As a result, the assumptions underlying the revenue projections and financial forecasts in Gama's application are no longer viable. Without the ability to lease the BBJ, Gama does not need a certificate of public convenience and necessity in connection with its ongoing Part 135 operations. Gama has therefore decided to withdraw its certificate application.

Were it not for the lack of an appropriate aircraft to support its proposed BBJ operations, Gama would have satisfied all of the Department's fitness requirements for certificate authority. Gama is withdrawing its application only because the aircraft for which it needed a certificate is unavailable a year after its application was filed. With BBJ operations no longer possible, Gama will continue to focus on its existing on-demand charter services as a Part 135 carrier utilizing aircraft for which a certificate from the Department is not required.

Notice of Withdrawal of Application

Hereby files this notice withdrawing its application for a certificate of public convenience and necessity to engage in foreign charter air transportation filed with the Department on October 23,2012. Gama is withdrawing its application for the reasons set forth in its Notice to withdraw its certificate application for interstate charter air transportation, filed with the Department today in Docket OST-2012-0181 and incorporated herein by reference.

Order Dismissing Application

On October 23, 2012, Gama Charters, Inc. filed an application in Docket OST-2012-0181 requesting a certificate of public convenience and necessity to engage in interstate charter air transportation of persons, property, and mail. Subsequently, on October 31, 2013, Gama filed a motion in the docket requesting that the Department dismiss its application without prejudice.

In light of the above, the Department dismisses, without prejudice, the application filed in Docket OST-2012-0181 by Gama.
