Application for Renewal of Exemption Authority

Harmony Airways, a Canadian carrier, applies for renewal of its exemption from 49 U.S.C. 41301 which authorizes it to provide (1) scheduled combination services between any point or points in Canada and any point or points in the United States, and (2) charter operations carrying persons, property and mail between Canada and the United States and other charters in accordance with 14 CFR Part 212.

The scheduled and charter authority for which renewal is requested was last granted on August 2, 2005. Harmony requests that its scheduled and charter authority be renewed for an additional one-year period, or such longer period as may be consistent with DOT policy.

The Department initially granted charter authority to HMY Airways Inc. on November 21, 2002 in Docket OST-2002-13576, and renewal authority on November 28, 2003.

The Department initially granted scheduled authority to HMY Airways Inc. on April 23, 2003 in Docket OST-2003-14679.

On May 12, 2004, HMY Airways Inc. applied to register the trade name "Harmony Airways" with the Department. The request was approved on May 13, 2004.

Harmony requests that the Department renew its exemption authority to provide (1) scheduled combination services between any point or points in Canada and any point or points in the United States, (2) charter operations carrying persons, property and mail between Canada and the United States and beyond, either directly or via intermediate points in other countries, with our without stopovers, coextensive with the rights provided under the "open skies" US-Canada Air Transport Agreement, and (3) other charters in accordance with 14 CFR Part 212, for a period of two years or such longer period as may be consistent with Department policy.
