Motion to Withhold Information from Public Disclosure

Island Airlines applies for authority to conduct interstate and foreign air transportation initially, and without limitation, planeload interstate passenger charter service - while, at the same time, continuing to operate scheduled intrastate passenger and cargo service between Nantucket, MA and Hyannis, MA and intrastate (MA) charter service. Island Air currently holds a Federal Aviation Administration Part 135 Operating Certificate and operations specifications for its intrastate scheduled and charter service. Utilizing its current authority, Island Air has successfully provided scheduled service between ACK and HYA - supplemented by occasional intrastate passenger and cargo charters - for over nineteen years.

Island Air anticipates that the primary market for its Interstate Charter Services will be predominantly between points in Southern Connecticut and Rhode Island, the greater New York TriState area, and the Cape and Islands region, on the one hand, and Nantucket and Martha's Vineyard, on the other. The majority of such flights would be conducted between the late spring and early autumn peak travel periods. Island Air's Cessna 4028 and its Caravan aircraft are ideally suited for such short-haul flights.

By this order, we tentatively find that Island Airlines, LLC, is a citizen of the United States and is fit, willing, and able to conduct operations as a commuter air carrier.

Island is currently operating as a scheduled intrastate air carrier under Part 135 operating authority. The air carrier has now requested commuter authority and plans to initiate interstate charter operations in the late fall and early spring months between points in Southern Connecticut and Rhode Island, the greater New York tri-state area, and the Cape and Islands region, on the one hand, and Nantucket and Martha’s Vineyard on the other, using its existing aircraft fleet of 6 Cessna 402Cs and 1 Cessna Caravan.

Order Confirming Oral Action and Issuing Effective Commuter Authorization

On November 22, 2010, Island updated its application with information regarding third-party verification of funds available to the air carrier that supported its ability to meet our financial fitness criteria, a copy of OST Form 6410 evidencing liability insurance meeting the requirements of 14 CFR 205.5(b), a copy of Island’s Air Carrier Certificate and Operation Specifications from the air carrier, and financial and other updated fitness information. Additionally, the air carrier stated that it had undergone no substantial changes in ownership, key personnel, compliance history, operating plans or financial posture since the issuance of the Show Cause Order, with the exception of removing one aircraft from its fleet, thereby bringing the total fleet count to 5 Cessna 402s and 1 Cessna Caravan. Island also requested that we make its authority effective prior to the expiration of the six day waiting period.

Our review of these documents was satisfactory. Under these circumstances, we concluded that there was no reason not to grant the company the waiver it requested and make its authority effective prior to the expiration of the six-day waiting period. Therefore, on November 22, 2010, we orally advised Island that we were making its commuter authority effective on that date.

Notice of Registration of Trade Name

On April 28, 2011, Island Airlines, LLC, a US commuter air carrier, requested that the Department register the trade name "Nantucket Shuttle" for use in air transportation operations.

Part 215 of the Department's regulations provides that any air carrier wishing to use an alternative trade name must first register that name with the Department. The rule further states that the Department may register such name after the air carrier gives notification to similarly named air carriers of the proposed use of the name.

In support of its request, lA states that it is acquiring the assets of Nantucket Shuttle, Inc., an intrastate air carrier located in Massachusetts, including certain aircraft, ticket books, and the use of the "Nantucket Shuttle" name. The transaction is expected to close on May 16, 2011, at which time NS will surrender its Part 135 operating certificate issued by the Federal Aviation Administration.

Since IA has complied with the requirements of Part 215, we acknowledge the registration of the trade name "Nantucket Shuttle" for use.

On April 27, 2012, Island Airlines, LLC, a US commuter air carrier, requested that the Department register the trade name “Ocean Wings Air Charter” for use in certain of its operations.

Part 215 of the Department’s regulations provides that any air carrier wishing to use an alternative trade name must first register that name with the Department. The rule further states that the Department may register such name after the air carrier gives notification to similarly named air carriers of the proposed use of the name.

In support of its request, IA states that Coastal Wings, Inc. d/b/a Ocean Wings, an air taxi operator in Massachusetts, has given IA permission to use the requested trade name, and has voluntarily surrendered its Part 135 operating certificate issued by the Federal Aviation Administration.

Since IA has complied with the requirements of Part 215, we acknowledge the registration of the trade name “Ocean Wings Air Charter” for use by IA.
