Application for an Exemption

Motion for Confidential Treatment

Performance Air Limited, a flag carrier of the Commonwealth of the Bahamas, respectfully requests an exemption from the provisions of 49 U.S.C. § 41301 to the extent necessary to permit it to engage in charter foreign air transportation of persons, property, and mail between a point or points in the Bahamas and a point or points in the United States, and other charters subject to Part 212 of the Department's Economic Regulations, using small aircraft as defined in 14 C.F.R. § 298.2. So that Performance Air may begin the proposed services as soon as possible, it requests that the Department grant the requested authority expeditiously and for an initial period of one year.

The Department has routinely authorized charter services by Bahamian carriers as a matter of reciprocity. See, e.g., Inter Island Charters Limited, Notice of Action Taken dated March 16, 2009 in Docket OST-2009-0039; Mitchell Enterprises Limited d/b/a Regional Air Services, Notice of Action Taken dated December 11, 2008 in Docket OST-2008-0319.

The record indicates that Mr. Kendall Ingraham owns 50% of Performance Air’s voting stock and Kenyoka and Jamaal Ingraham each own 25% of the remaining voting stock. All are Bahamian citizens.

The applicant specifically states that it is applying to provide the service requested using small aircraft.

The Notice permitted Performance Air to engage in charter foreign air transportation of persons, property, and mail between a point or points in the Bahamas and a point or points in the United States, and other charters pursuant to 14 CFR Part 212 of the Department’s regulations, using small aircraft. Performance Air inadvertently allowed its exemption to expire, but it now is working toward the FAA authority necessary for it to commence US operations and therefore wishes to restore its DOT authority.

DE C.V., a Mexican air taxi operator of executive aircraft, pursuant to 49 USC 40109 and subpart D of the Department's Procedural Regulations, requests an exemption from 49 USC 41301 to authorize PERFORMANCE AIR, S.A.P.I. DE C.V. to engage in foreign charter air transportation of persons, with small aircraft between Mexico and the United States and, subject to prior Department approval, between other countries and the United States. As more fully described herein, PERFORMANCE AIR, S.A.P.I. DE C.V. also requests unlimited stopover privileges and relief from the requirements to obtain advance approval for each Mexico-US flight. PERFORMANCE AIR, S.A.P.I. DE C.V. requests that this exemption be granted for a period of at least two years.
