Application for Amendment of Exemption

As a result of the Tongan Government's arrangement with New Zealand, Royal Tongan understands that the FAA will very shortly announce that Tonga has achieved Category 1 status under the IASA program and that Tongan carriers, including Royal Tongan, may therefore serve United States points with their own aircraft and crews. Royal Tongan therefore requests that the Department amend Royal Tongan's exemption by removing from the exemption the wet lease requirement.

Royal Tongan will initially operate weekly service between Tonga and Honolulu-a market not served by any other carrier, U.S. or foreign. Royal Tongan will conduct operations with a B757-200ER aircraft dry leased from Royal Brunei Airlines. This aircraft is currently part of Royal Tongan's fleet and was operated previously under a wet lease arrangement with Royal Brunei Airlines to points in the South Pacific. At the end of August, Royal Tongan will initiate operations with this aircraft on a dry leased basis between the Cook Islands and Auckland. Service between Tonga and Honolulu will commence several weeks later on September 17.

Correspondence of Royal Tongan

I am writing to confirm that Royal Tongan Airlines will operate its Tonga‑U.S. services only via an FAA and TSA approved last point of departure, initially Apia, Samoa, pending completion of the TSA's assessment of the airport in Nuku'alofa, Tonga. As soon as this assessment has been completed, Royal Tongan plans to institute service directly between Tonga and the United States.

Motion for Immediate Amendment of Exemption

On August 7, 2003, Royal Tongan Airlines requested that the Department of Transportation amend Royal Tongan's existing exemption authority to remove a condition requiring that it operate services to the United States utilizing wet leased aircraft. Royal Tongan's amendment request was based on the Federal Aviation Administration's upgrade of Tonga to Category 1 under the FAA's IASA program. That upgrade was communicated to the Government of Tonga by diplomatic note dated August 21, 2003, a copy of which is attached to this motion. 

Nearly four months later, the Department still has not acted on Royal Tongan's application, forcing Royal Tongan to repeatedly delay its inauguration of service to Honolulu. As a result of this continuing and unwarranted delay, Royal Tongan is now in serious danger of missing its next planned start date on December 5, 2003. Royal Tongan cannot afford to schedule another commencement date, nor should it be required to do so.

Exemption from 49 USC section 41301 to permit the applicant to conduct, using its own aircraft and crews, scheduled, combination services between the terminal point Tongatapu, Tonga, and the two U.S. coterminal points Honolulu and Los Angeles. (By letter to the Department dated November 13, 2003, the applicant states that it plans to conduct this U.S. operation only via Apia, Samoa, until a successful security assessment is made by TSA at the airport in Tonga.)

Application for Amendment of Exemption

Hereby requests amendment of its exemption authority granted to it by the Department of Transportation in the above-captioned docket to permit Royal Tongan to operate via intermediate points on its existing scheduled services between Tonga, on the one hand, and the coterminal points Honolulu, Hawaii, and Los Angeles, California, on the other hand.

Royal Tongan requests that its existing exemption permitting it to operate between Tonga and the coterminal points Honolulu and Los Angeles be amended to authorize Royal Tongan to operate on this route via intermediate points. Royal Tongan currently holds a short-term exemption permitting it to serve Honolulu and Los Angeles via Apia. This service has been well-received by passengers and Royal Tongan wishes to maintain in effect its ability to operate to the United States via Apia as well as via other intermediate points, consistent with MALIAT.

Royal Tongan provides service between Tonga and various points in the South Pacific, including Apia, Auckland, Sydney, Ha'apai, Vava'u, Nadi, Niuatoputapu and Nuku'alofa utilizing B757‑200ER and Twin Otter aircraft. Royal Tongan also serves Honolulu with its B757‑200ER aircraft.
