Application for an Exemption

Sky Lease respectfully requests an exemption from the provisions of 49 USC § 41101 and a designation under the Air Transport Agreement, as amended, between the United States and the People's Republic of China to the extent necessary to permit Sky Lease it to engage in the scheduled foreign air transportation of property and mail between a point or points in the United States, on the one hand, and a point or points in the People's Republic of China, on the other, via intermediate points, and beyond China. Sky Lease also requests authority to integrate this authority with its existing exemption and certificate authority. The exemption is requested for an initial period of two years.

Sky Lease initially plans to operate multiple, weekly MD-11F services between the U.S. and China, serving the Miami-Anchorage-Shanghai market with additional, potential service to Houston, Chicago, and Los Angeles.

Both Sky Lease and its commonly-owned affiliate, Centurion Air Cargo, are applying for these newly-unrestricted scheduled, all-cargo rights.

Sky Lease I, Inc. respectfully requests renewal of the above-captioned exemption, granted by Notice of Action Taken dated April 8, 2013, for an additional, two-year period. The Notice, set to expire on April 8, 2015, permits Sky Lease to engage in scheduled foreign air transportation of property and mail between a point or points in the United States, on the one hand, and a point or points in the People’s Republic of China, on the other hand, via intermediate points and beyond China; it also authorizes Sky Lease to integrate this exemption authority with its existing authority.

Sky Lease wishes to have the flexibility to operate scheduled service to and from China in the future.

Application for an Exemption

Sky Lease respectfully requests an exemption from the provisions of 49 USC § 41101 and the Department’s rules to the extent necessary to permit Sky Lease to provide scheduled foreign air transportation of property and mail between a point or points in the United States, on the one hand, and Hong Kong, on the other, via intermediate points and beyond to points in third countries. Sky Lease also requests that the Department authorize Sky Lease to integrate this authority with its existing exemption and certificate authority, grant the exemption for an initial period of two years, and promptly designate Sky Lease under the Air Transport Agreement between the Government of the United States and the Government of the Hong Kong Special Administrative Region of the People’s Republic of China, as amended.

Sky Lease proposes to commence US-Hong Kong scheduled service, using freighter aircraft already in its fleet, on a twice-weekly basis, operating from Miami via Tokyo to Hong Kong and returning via Anchorage to a point or points in the US Sky Lease does not intend to carry local Tokyo-Hong Kong traffic and recognizes that any Hong Kong operations serving intermediate or beyond points would be without local traffic rights unless it secures the appropriate fifth-freedom frequencies.

Sky Lease I, Inc. respectfully requests an exemption from the provisions of 49 USC § 41101 and the Department’s rules, and a designation, to the extent necessary to permit Sky Lease to provide scheduled foreign air transportation of property and mail: (i) from a point or points in the United States, via intermediate points, to a point or points in Ecuador and beyond; and (ii) between Ecuador and any point or points. Sky Lease also requests that the Department authorize Sky Lease to integrate this authority with its existing exemption and certificate authority, grant the exemption for an initial period of two years, and promptly designate Sky Lease under the Air Transport Agreement between the Government of the United States and the Government of Ecuador, as amended.

Sky Lease currently operates non-scheduled, freighter service between Miami and Quito up to four times weekly as part of its broader, South American operations; it proposes to replace the nonscheduled service with scheduled service.

Sky Lease provides extensive scheduled and charter service in international markets with B747 and MD-11 freighter aircraft.

Sky Lease also requests that this exemption authority be integrated with its existing exemption and certificate authority.

Sky Lease also requests that the Department promptly designate Sky Lease under the Air Transport Agreement between the Government of the United States and the Government of Ecuador, as amended. We will handle the designation request separately through normal diplomatic channels.

OST-2019-0001 - Violations of 49 USC § 41708 and 14 CFR 241

Consent Order

This consent order concerns reporting delinquencies by Sky Lease I, Inc., that constitute violations of 49 USC § 41708 and the accounting and reporting requirements specified in 14 CFR Part 241. This order directs Sky Lease to cease and desist from future violations, and assesses the carrier a compromise civil penalty of $45,000.

Sky Lease is a large certificated air carrier and is therefore subject to the reporting requirements of 49 USC § 41708 and 14 CFR Part 241. Sky Lease failed to submit timely and complete traffic and financial reports during reporting periods through 2016. In early 2017, Sky Lease brought itself current with respect to its reporting obligations; however, in 2017 and 2018, the Department discovered additional reporting delinquencies.

Sky Lease states that any violation of the Department's reporting requirements was inadvertent. During the relevant period Sky Lease shifted its operating base from Greensboro, NC to Miami, FL, and DOT reporting matters and correspondence shifted between two departments. Sky Lease has centralized its reporting function and has procedures in place to ensure future, timely, and accurate reporting.
