Application for a Foreign Air Carrier Permit and an Exemption

SW Italia requests a foreign air carrier permit authorizing it to engage in: ( 1) scheduled and on-demand charter transportation of cargo between any point or points in Italy, via intermediate point or points, and any point or points in the United States and beyond; (2) foreign scheduled and charter air transportation of cargo from any point or points behind any Member State of the European Union, via any Member State, and via intermediate points, to any point or points in the United States and beyond; (3) foreign scheduled and charter air transportation of cargo between any point or points in the United States and any point or points; and ( 4) scheduled and charter transportation authorized by any additional rights that may be made available to European Community carriers in the
future.

SW Italia plans to open its US operations with scheduled flights between Milan, Italy and Chicago, IL, US, as soon as the Department permits them. For its contemplated services, SW Italia intends to operate its Boeing 747 freighter equipment. SW Italia may further expand the proposed services and use other aircraft in the future. SW Italia estimates that its average cargo revenue per charter flight between Milan, Italy and points in the U.S. East Coast, will constitute $163 ,200.00 per flight with the 80% average load factor and based on the average cargo rates of$ 1.60 per kilo.

SW Italia is based at Milan Malpensa International Airport. Its business is focused on scheduled and charter cargo transportation services between points in Italy and the European Union and multiple other destinations worldwide. SW Italia is looking to develop its reputation as a reliable cargo carrier with a significant network ofroutes focusing on major cargo destinations in Europe, Asia and the Americas.

Order Granting Exemption and Show Cause

We grant the request of SW Italia S.p.A. for an exemption under 49 USC §40109 for the services:

  1. foreign scheduled and charter air transportation of property and mail from points behind any Member State of the European Union, via any point or points in anyMember State and via intermediate points, to any point or points in the United States and beyond;
  2. foreign scheduled and charter air transportation of cargo between any point or points in the United States and any point or points; and
  3. scheduled and charter cargo transportation authorized by any additional rights that may be made available to European Union carriers in the future.

With respect to the applicant’s request for a foreign air carrier permit in this proceeding, we direct all interested persons to show cause why our tentative decision on that application, set forth above, should not be made final. Any interested person objecting to the issuance of an order making final our tentative findings and conclusions with respect to the applicant’s request for a foreign air carrier permit shall, no later than twenty-one calendar days after the date of service of this order, file with the Department.

Final Order

By Order 2016-8-12, issued August 8, 2016, we directed all interested persons to show cause why we should not make final our tentative findings and conclusions stated therein and award a foreign air carrier permit in the form attached to the Order and subject to the conditions attached thereto. We gave interested persons 21 days to file objections to the Order. We said that if no objections were filed, all further procedural steps would be deemed waived, and the Department would enter an order (subject to Presidential review under 49 USC.§41307) which would make final the findings and conclusions of the Order.

No objections were received within the time period provided.
