TUIfly Nordic A.B. applies for an exemption and an amended foreign air carrier permit authorizing TUIfly to conduct operations to and from the United States to the full extent authorized by the United States-European Union Air Transport Agreement, including authority to engage in: (a) charter foreign air transportation of persons, property and mail from any point(s) behind any Member State(s) of the European Community via any point(s) in any Member State(s) and intermediate points to any point(s) in the United States and beyond; (b) charter foreign air transportation of persons, property and mail between any point(s)in the United States and any point(s) in any member of the European Common Aviation Area; (c) charter foreign cargo air transportation between any point(s) in the United States and any other point(s); (d) other charters pursuant to the prior approval requirements set forth in Part 212 of the Department's Economic Regulations; and (e) transportation authorized by any additional route or other right(s) made available to European Community carriers in the future.

TUlfly requests that the authority described above be issued as soon as possible. TUlfly also requests the Department to issue a single order: (1) granting the requested exemption authority for a two-year period or until the requested permit authority becomes effective, whichever occurs earlier; and, (2) approving the corresponding foreign air carrier permit amendment request under the show-cause procedures described in the August 23, 2005 Notice, unless the Department determines that proceeding directly to a final order issuing an amended foreign air carrier is appropriate.

TUlfly is making final preparations to commence operations between Stockholm-Arlanda, Sweden, Oslo, Norway, to Fort Lauderdale, Florida, beginning October 24, 2008. TUlfly currently holds a foreign air carrier permit, issued on December 5, 2001 in Docket OST-2000-8155, which authorizes the airline to conduct foreign charter air transportation of passengers and their baggage between any point or points in Sweden, Denmark and Norway on the one hand, and any point or points in the United States, on the other. TUlfly is also authorized to conduct such passenger charter services between a point or points in the United States and any point or points in a third country without prior Department approval, provided that such service constitutes part of a continuous operation that includes service to Sweden, Denmark and/or Norway for the purpose of carrying local traffic between Sweden, Denmark and Norway and the United States.
