Nord Wind is requesting a foreign air carrier permit and an exemption authorizing it to engage in on-demand charter transportation of passengers, property and mail between point(s) in the Russian Federation and point(s) in the United States, as well as between point(s) in the United States and point(s) in a third country or countries subject to terms, conditions and limitations of 14 CFR Part 212 and pertinent national, bilateral and international rules and regulations.

Nord Wind is based at Moscow Sheremetyevo Airport. It specializes in passenger and combination charter transportation services and operates charter flights from Moscow to Spain, Austria, Italy, and Greece, as well as to the key popular tourist destinations in Turkey, Egypt, Tunisia, India, Thailand, Indonesia and China.

Nord Wind had developed its reputation as a well-known and reliable passenger and cargo combination charter operator with a significant network of domestic and international routes focusing on major tourist destinations in Europe, Asia and Africa.

Nord Wind will utilize its Boeing 767-300 equipment for its proposed US operations. All of the aircraft Nord Wind intends to operate to the United States are registered in Bermuda.

Order Granting Exemption and to Show Cause

We grant the request of LLC Nord Wind for an exemption under 49 USC §40109 to permit it to engage in (1) charter foreign air transportation of persons, property and mail between any point or points in the Russian Federation and any point or points in the United States; and (2) other charters in accordance with 14 CFR Part 212 of the Department’s regulations.

With respect to the applicant’s request for a foreign air carrier permit in this proceeding, we direct all interested persons to show cause why our tentative decision on that application, set forth above, should not be made final. Any interested person objecting to the issuance of an order making final our tentative findings and conclusions with respect to the applicant’s request for a foreign air carrier permit shall, no later than twenty-one calendar days after the date of service of this order, file with the Department.

Final Order

By Order 2012-11-2, issued November 8, 2012, we directed all interested persons to show cause why we should not make final our tentative findings and conclusions stated therein and award a foreign air carrier permit in the form attached to the Order and subject to the conditions attached thereto. We gave interested persons 21 days to file objections to the Order. We said that if no objections are filed, all further procedural steps shall be deemed waived, and the Department will enter an order (subject to Presidential review under 49 USC §41307) which will make final the findings and conclusions of the Order.

No objections were received within the time period provided.

Application to Amend Foreign Air Carrier Permit and for an Exemption

In addition to its charter authority, in June 2016 Nord Wind was designated by the Government of the Russian Federation to operate scheduled air transportation service between Moscow Sheremetyevo International Airport/SVO, Russian Federation and Miami, FL. Such designation is being in due course transmitted to the Government of the United States by the Government of the Russian Federation.

Nord Wind hereby requests that its foreign air carrier permit authority be amended to add the scheduled air transportation service. Specifically, in accordance with the terms of its designation , and subject to the provisions of Section I of Annex IV to Air Transport Agreement between the Government of the United States and the Government of Russia, Nord Wind hereby requests a foreign air carrier permit authorizing it to engage in (1) scheduled air transportation of persons , propert y and mail between point or points in the Russian Federation, via intermediate points, and Miami, Florida, USA, and beyond; and between points on such routes and any points in third countries through points in the territory of the Russian Federation; as well as (2) charter air transportation of persons, property and mail between any point or points in Russia and any point or points in the United States, as well as any point or points the United States and any point or points in a third country or countries subject to pertinent national, bilateral and international rules and regulations. Nord Wind intends to start operating the requested service (with continuing service to Cancun, Mexico) as soon as the department approves it using its Boeing 777-200 equipment. Nord Wind may further expand the proposed services using other aircraft in the future.

95.1% of Nord Wind's stock is held by the limited liability company "Pegas," a company organized and registered under the laws of the Russian Federation and wholly owned by Karine Bukrey, a citizen of the Russian Federation. 4.9% of Nord Wind's stock is held individually by Karine Bukrey.
