Aztec Worldwide Airlines Inc. submits this application for authority to operate scheduled passenger service as a commuter air carrier. Applicant is currently engaged in the on-demand air taxi business, in the carriage of cargo and passengers.

Applicant requests authority to engage in scheduled passenger and cargo operations as a commuter and proposes to operate:

5 roundtrip flights weekly between Fort Lauderdale, Florida and Eleuthera Island Bahamas utilizing two, 9 passenger Piper PA-31-350 aircraft.

Amerijet International supports this application. Aztec Worldwide Airlines has been an interline partner of Amerijet for several years. As a US Part 121 Certificated All Cargo Carrier, we rely on utilizing interline partnerships to service parts of the world which do not have the market maturity or operational capability to support large transport category aircraft, and yet we have business to these destinations. The customers who ship to and from these markets demand expedited services and frequencies which are not available to them today. Aztec Worldwide Airlines operates aircraft of a size and economics which can offer the frequencies desired while still insuring economic stability for the company.

Order to Show Cause Proposing Issuance of Commuter Air Carrier Authority

In this order, we tentatively find that Aztec Worldwide Airlines, Inc. d/b/a Aztec Airways is a citizen of the United States and is fit, willing, and able to conduct scheduled passenger operations as a commuter air carrier, subject to conditions.

The applicant seeks to become a commuter air carrier operating scheduled service between Fort Lauderdale, Florida and two points on Eleuthera Island in the Bahamas: North Eleuthera and Governor’s Harbour. Aztec plans to operate five round trip flights per week carrying both passengers and cargo, an increase of two additional flights above its current operations. The applicant currently operates five aircraft. Of the five aircraft, two will be used in Aztec’s proposed commuter operations (Piper PA-31-350).

We direct all interested persons to show cause why we should not issue an order finding that Aztec Worldwide Airlines, Inc. d/b/a Aztec Airways is fit, willing, and able under 49 USC § 41738 to provide scheduled passenger service as a commuter air carrier using small aircraft pursuant to Part 135 of the Federal Aviation Regulations.

Final Order

By Order 2016-12-26, issued December 28, 2016, we directed all interested persons to show cause why we should not make final our tentative findings and conclusions that Aztec Worldwide Airlines, Inc., is fit, willing, and able to provide scheduled passenger service as a commuter air carrier using small aircraft pursuant to Part 135 of the Federal Aviation Regulations. Interested persons were given 14 days to file objections to the order. No objections to the show cause order were received.

Response to Final Order

Exhibit A is a copy of Aztec Worldwide Airlines Inc.’s FAA Air Carrier Certificate and amended portions of its Operations Specifications authorizing scheduled operations.

Exhibit B is a certificate of insurance on OST Form 6410 evidencing liability insurance coverage meeting the requirements of 14 CFR § 205.5(b).

Aztec Worldwide Airlines Inc. has undergone changes to its ownership, key personnel, operating plans, financial posture, or compliance history since the date of the Show Cause Order (Order 2016-12-26) in this proceeding.

As noted in its application, because Aztec Worldwide Airlines Inc. already operates as an existing on-demand air carrier, including on the proposed scheduled routes, it has not incurred and does not expect to incur pre-operating expenses associated with the scheduled operations it proposes, In a Request For More Information dated April 26, 2016 the Department estimated that Aztec Worldwide Airlines Inc. will need approximately $128,456 to meet the Department’s financial fitness test. On July 16, 2016, Aztec Worldwide Airlines Inc. provided the Department with a statement from Mr. Stuart Hanley, President of Aztec Worldwide Airlines Inc., confirming he will make available his personal funds to Aztec Worldwide Airlines Inc. to the extent necessary to cover Aztec Worldwide Airlines Inc.'s working capital needs to satisfy the Department's working capital reserve requirement. Enclosed as Exhibit D is a Statement of Account providing third-party verification that Mr. Hanley has a balance of $286,110.56 in his personal I R A account. Accordingly, Mr. Hanley has on deposit more than sufficient funds in his personal account to satisfy the Department's working capital reserve requirement.

Response of Aztec Worldwide Airlines to Final Order

On January 13, 2017, the Department issued a Final Order 2017-1-13 granting Aztec Worldwide Airlines Inc. D/B/A ‘Aztec Airways’ a Commuter Air Carrier Authorization subject to the Terms, Conditions, and Limitations attached thereto. Provision 1 of those Terms, Conditions, and Limitations requires Aztec Worldwide Airlines Inc. provide certain information and documentation before the Department makes effective the Commuter Air Carrier Authorization. Aztec Worldwide Airlines Inc. hereby submits the following information and documentation to satisfy the requirements of provision 1:
