Application for Exemption

Air Côte d’Ivoire hereby requests an exemption to permit Air Côte d’Ivoire to engage in the scheduled foreign air transportation of persons, property and mail from points behind Côte d'Ivoire, via Côte d'Ivoire and intermediate points, to a point or points in the United States and beyond, subject to a wet lease or codeshare arrangement with a duly authorized US or foreign air carrier.

Air Côte d'Ivoire’s fleet consists currently of four Airbus A319-100, two Airbus A320-200, and four Bombardier Q-400 aircraft. The company’s domestic services include: Odienné, Korhogo, Man, Bouake, San-Pédro, Abidjan. Its regional West Africa services include: Abuja, Accra, Bamako, Brazzaville, Conakry, Cotonou, Dakar, Freetown, Lagos, Libreville, Lomé, Monrovia, N’Djamena, Niamey, Ouagadougou, Kinshasa, Pointe Noire and Yaoundé.

Air Côte d’Ivoire intends to begin service to the United States via a codeshare arrangement with an authorized US or foreign air carrier shortly after the Department’s approval of this application and its partner’s statement of authorization. Air Côte d’Ivoire’s codeshare partner will operate the US-third country segment and Air Côte d’Ivoire will operate the third country-Côte d'Ivoire segment. Alternatively, Air Côte d’Ivoire’s codeshare partner may operate both the US-third country and third country-Côte d'Ivoire segments, depending on commercial conditions. Air Côte d’Ivoire will not operate to any US point with its own aircraft and crews until Côte d'Ivoire is placed in Category 1 by the FAA.

Exemption from 49 USC § 41301 to engage in scheduled foreign air transportation of persons, property and mail from points behind Côte d’Ivoire, via Côte d’Ivoire and intermediate points to a point or points in the United States and beyond, subject to a wet-lease or codeshare arrangement with a duly authorized US or foreign air carrier. Air Côte d’Ivoire requests that its exemption be granted for a period of at least two years.

The applicant states that it intends to commence Côte d’Ivoire-US services under a code-share arrangement with another carrier but will not do so until that carrier obtains a statement of authorization and any other required authority from the Department.

Air Côte d’Ivoire hereby requests renewal of the exemption authority granted to it by the Department of Transportation in the above-captioned docket to engage in scheduled foreign air transportation of persons, property and mail from points behind Côte d’Ivoire, via Côte d’Ivoire and intermediate points, to a point or points in the United States and beyond, subject to a wet lease or codeshare arrangement with a duly authorized US or foreign air carrier. Air Côte d’Ivoire requests renewal of this exemption for a two-year period.

The applicant states that it currently provides Côte d’Ivoire-US services through a codeshare arrangement with Ethiopian Airlines. See Docket OST-2018-0093, July 20, 2018, (granting Ethiopian Airlines a blanket statement of authorization of indefinite duration to display Air Côte d’Ivoire’s “HF” designator code on flights operated by Ethiopian between the United States and Ethiopia). Air Côte d’Ivoire’s codeshare partner operates the US-third country segment and Air Côte d’Ivoire operates the third country-Côte d'Ivoire segment. Air Côte d’Ivoire further states that it will not operate to any US point with its own aircraft and crews until Côte d'Ivoire is placed in IASA Category 1 by the FAA.
