Application for a Foreign Air Carrier Permit, an Exemption and a Statement of Authorization

Eurowings Europe hereby applies for a foreign air carrier permit and an exemption granting it the full rights available to EU Member State air carriers pursuant to the Air Transport Agreement between the United States and the European Union and its Member States. Eurowings Europe requests that the Department grant it an exemption from 49 USC § 41301 to provide the services covered by this application while Eurowings Europe's application for a foreign air carrier permit is pending.

Eurowings Europe also requests a statement of authorization under 14 CFR Part 212 to wet lease aircraft to Eurowings GmbH on a long-term basis. Eurowings Europe requests this authority to operate flights on which it will display the ("UA*") designator code of United Airlines that Eurowings Europe operates as wet lessor to Eurowings within Europe and beyond to third countries. Eurowings Europe requests that the Department make the statement of authorization effective for an indefinite period.

Issued and Served May 14, 2019

Order Granting Exemption, Statement of Authorization, and To Show Cause

Foreign scheduled and charter air transportation of persons, property, and mail from
any point or points behind any Member State of the European Union, via any point or
points in any Member State and via intermediate points, to any point or points in the
United States and beyond;

Foreign scheduled and charter air transportation of persons, property, and mail
between any point or points in the United States and any point or points in any member
of the European Common Aviation Area;

Foreign scheduled and charter air transportation of cargo between any point or points
in the United States and any other point or points;

Other charters pursuant to the prior approval requirements set forth in 14 CFR Part
212 of the Department’s economic regulations; and

Transportation authorized by any additional route rights made available to European
Union carriers in the future; provided, that the holder shall, before it commences any
new service under such additional route rights, provide the Department with evidence
that it holds a homeland license for that new service (unless it has already provided such
evidence to the Department). Such evidence shall be filed in Docket DOT-OST-2019-
0030.

The Department is acting concurrently on the corresponding April 2, 2019, application of United for amended exemption authority. See Docket DOT-OST-2004-19148.
